Brookey Barker - Sales of Shepherdsville Lots for Taxes

Brookey Barker was selected as Shepherdsville Property Tax Collector for 1828, and in this document and another one he identifies lots and parts of lots that were sold for taxes.

Whereas the trustees of the town of Shepherdsville in Bullitt County, State of Kentucky did on the 14th day of April 1828 levy a tax of $.30 on each $100 valuation of the lots and parts of lots in said town as returned by the commissioner collectible in the year 1828, and by their order directed the collector of the town tax if the taxes on the lots and parts of lots should not be paid by the owners or occupiers thereof, to sell said lots and parts of lots to satisfy said taxes, first advertising the time and place of sale for three weeks at the courthouse door in Shepherdsville and at two other public places in Bullitt County.

The said trustees also directed that the owners of the said lots so sold should have a right to redeem the same in two years from the day of sale by paying the amount of taxes and all costs attending the sale with 10% on the amount, all which will be seen by reference to the orders, appointing Brookey Barker collector of the town taxes, and levying the taxes for the year 1828 in the minutes book of the said trustees.

And whereas also the said Brookey Barker, collector as aforesaid, not being able to collect the amount of taxes due on the following lots, to-wit: Nos. 1 and 17 which had been listed in the name of Robert Brashear; No. 16 in the name of Joshua Stansbury; No. 18 in the name of Henry Crist; Nos. 19 and 33 in the name of John Scott Jr.; No. 54 in the name of George W. Summers and the heirs of John L. Summers dec'd; and lot No. 87 which had been listed by the said commissioners in the name of Rufus K. Summers, but which was owned by Whitledge Overall, as by the direction and order of the said trustees after advertising agreeably to said order, did on the 2nd day of August 1828 publicly in market overt offer for sale parts of said lots to satisfy the taxes due thereon, but no person being willing to pay the taxes for the parts offered, the said whole lots were then offered for sale, and were then and there actually sold and Rufus K. Summers being the highest bidder purchased the said lots 1 & 17 for the sum of 24 cents, being the amount of tax due thereon as aforesaid; lot No. 2 for the sum of 9 cents, being the tax due thereon; Lot No. 16 for the sum of 9 cents, being the amount of tax due thereon; lot No 18 for the sum of 15 cents, being the amount of tax due thereon; Lots Nos. 19 & 33 for the sum of 24 cents, being the amount of tax due thereon; Lot No. 54 for the sum of 60 cents, being the amount of tax due thereon; and lot No. 87 for the sum of 6 cents, being the amount of tax due thereon; all which will be seen by reference to the list of lots sold for the taxes due for the year 1828, returned by the said Brookey Barker, collector as aforesaid to the said trustees and filed with their papers.

Now this indenture madee this 18th day of September 1828 between the said Brookey Barker, collectoras aforesaid, of the one part, and the said Rufus K. Summers of the other part.

Witnesseth that the said Brookey Barker, collector as aforesaid, for and in consideration of the sale and purchase aforesaid, the payment of the several sums of money aforesaid by the said Rufus K. Summers, the receipt whereof is hereby acknowledged, and in consideration of the power vested in my by law, hath and by these presents doth grant, alien, release, convey and confirm unto the said Rufus K. Summers, his heirs &c all the right, title, interest and claim of the said Robert Brashear, Frederic Pennebaker, Joshua Stansbury, Henry Crist, John Scott Jr., George W. Summers and the heirs of John L. Summers dec'd and Whitledge Overall from and to the lots aforesaid.

To have and to hold the said lots with all and singular the appurtenances unto the said Rufus K. Summers, his heirs &c and to his and their only proper use, benefit and behoof forever against the claim or claims of all and every person or persons whatsoever. In testimony whereof the said Brookey Barker, collector as aforesaid, hath hereto set his hand and seal on the day and year within written.
