John Scott (by Tax Collector) to John Scott Jr. - 2 Town Lots

It appears that John Scott possessed town lots 19 and 33, and had failed to pay town tax for 1827. Henry F. Kalfus, the tax collector, was obligated to sell the lots, and according to this deed the lots were bought by John Scott Jr. However, the next year Brookey Barker, tax collector for 1828, sold the lots again for taxes, and they were purchased by Rufus K. Summers.

Whereas the trustees of the town of Shepherdsville levied for the year 1827 a tax on the lots of said town and directed Henry F. Kalfus, the town collector, to sell the said lots if the taxes should not be paid, subject nevertheless to be redeemed in two years from the date of said sale. In pursuance of which order and directions, the said Henry F. Kalfus, collector as aforesaid, after advertising agreeably to said order, did on the 2nd day of June 1827 sell Lots No. 19 and 33 in the new plan of said town, which had been listed for taxation for the year 1827 in the name of John Scott and John Scott Jr. became the purchaser as will appear by the following certificate.

State of Kentucky. I Henry F. Kalfus, town collector, do certify that after advertising agreeably to the order of the trustees of the the town of Shepherdsville, I did on this 2nd day of June 1827 publicly expose to sale Lots No. 19 and 33 in the new plan of the said town which had been listed for taxation for the year 1827 in the name of John Scott and John Scott Jr. purchased the same for the amount of the taxes due thereon, which lots were sold subject to be redeemed by the said John Scott in two years from the day of sale, June 2nd 1827. This indenture therefore made this 28th day of November 1827 between the said Henry F. Kalfus, collector as aforesaid, of the one part and the said John Scott Jr. of the other part. Witnesseth that the said Henry F. Kalfus, collector as aforesaid, for and in consideration of the premises and the power vested in him hath and by these presents doth grant, bargain and sell, alien, release, convey and confirm unto the said John Scott Jr. his heirs &c all the right, title, interest and claim of him the said John Scott of in and to the said lots No. 19 and 33 in the new plan of the said town of Shepherdsville, subject to be redeemed as aforesaid.

To have and to hold the said lots and appurtenances unto him the said John Scott Jr., his heirs &c and to his and their only proper use, benefit and behoof forever against the claim or claims of all persons claiming or to claim the same, warranting as fully as said collector can warrant subject nevertheless to the said John Scott's right of redeeming said lots as aforesaid. In testimony whereof the said Henry F. Kalfus, collector as aforesaid, hereto sets his hand and seal on the day and year written.
