Rebecca Newkirk Heirs to Rachael Lux - Part of Mt. Washington Lot 74

On 8 Sep 1830, Samuel Brown sold Mt. Washington lot No. 78 to Elizabeth Hall. Brown was the original purchaser of this lot [see Deed Book C, page 507] at the first sale of town lots. It appears from the deed that Elizabeth was already living there. In the 1840 census, Elizabeth's age was given as between 70-79. She died on 28 Sep 1840 and is buried in the Newkirk Cemetery in Bullitt County. At her death the lot descended to her two children Rebecca Newkirk and John S. Hall.

Rebecca and John had purchased the adjoining lot 74 from Samuel Gentry in 1844. On 9 Feb 1846, John S. Hall sold his half share of lots 74 and 78 to Austin Hough. Then on 5 Dec 1846, Rebecca and Austin agreed on a division of the property.

Following Rebecca Newkirk's death on 9 Jan 1852, her heirs sold her share of Lot 74 to Rachael Lux in August of the following year, as shown below. Near the end of her life, Rachael Lux wrote a will leaving control of her estate to her son John T. Lux. In December 1890, he sold her Mt. Washington property to Benjamin Brumley.

This indenture made and entered into this __ day of August in the year 1853 between Austin Hough, Asa Newkirk, Charles C. Newkirk, Clifton H. Newkirk, Louisa Newkirk of the county of Bullitt, John H. Newkirk of the county of Jefferson, and Samuel Gentry and Elizabeth Gentry, late Elizabeth Newkirk of the county of Henderson, and all of the state of Kentucky of the first part and Rachael Lux of the county of Bullitt and state aforesaid of the second part.

Witnesseth that the party of the first part for and in consideration of the sum of $150 in hand paid by the party of the second part, the receipt whereof is hereby acknowledged, hath granted, bargained and sold and by these presents do grant, bargain and sell unto the party of the second part, her heirs and assigns, all that lot or parcel of land situate lying and being in the town of Mt. Washington and county of Bullitt and known and designated on the plan of Mt. Washington on the northwest part of Lot No. 74, fronting on Main Street 61' and running back to South Street or Spring Street parallel with the line of Lot No. 78 to Spring or South Street, thence with the same and fronting on the same 61' to the corner of Lot No. 70, thence with the line of the same to Main Street, and is that part of said Lot No. 74 in said town on which the residence of the late Elizabeth Hall stood.

To have and to hold the same to the only proper use and behoof of the party of the second part, her heirs and assigns, the partys of the first part covenant and agree to and with the party of the second part that they will and their heirs shall and will forever warrant and defend the title of said part of lot as above described to the party of the second part, her heirs and assigns forever and against the claim or claims of all and every person or persons claiming or to claim the same in any manner whatsoever.

In witness whereof the said Austin Hough, Asa Newkirk and America Newkirk his wife, Charles C. Newkirk, Clifton H. Newkirk, John H. Newkirk and Fanny Newkirk his wife, Louisa Newkirk, and Samuel Gentry and Elizabeth his wife, all of whose wives hereby relinquish their rights of dower in and to the part of Lot hereby conveyed in this deed, have hereunto set their hand and affixed their seals this day and year first above written.
