John T. Lux to Benjamin Brumley - Mt. Washington Lots 74 & 78

On 8 Sep 1830, Samuel Brown sold Mt. Washington lot No. 78 to Elizabeth Hall. Brown was the original purchaser of this lot [see Deed Book C, page 507] at the first sale of town lots. It appears from the deed that Elizabeth was already living there. In the 1840 census, Elizabeth's age was given as between 70-79. She died on 28 Sep 1840 and is buried in the Newkirk Cemetery in Bullitt County. At her death the lot descended to her two children Rebecca Newkirk and John S. Hall.

Rebecca and John had purchased the adjoining lot 74 from Samuel Gentry in 1844. On 9 Feb 1846, John S. Hall sold his half share of lots 74 and 78 to Austin Hough. Then on 5 Dec 1846, Rebecca and Austin agreed on a division of the property.

Following Rebecca Newkirk's death on 9 Jan 1852, her heirs sold her share of Lot 74 to Rachael Lux in August of the following year. In 1854 Austin Hough sold his share of lots 74 & 78 to Jacob N. Boswell who then sold it to Charles Hall the next year. Charles Hall sold it to W. W. Hall in 1866. Then in 1871, W. W. Hall sold the ground to Rachael Lux's son Joseph F. Lux.

Joseph F. Lux sold this ground to James T. Cunningham in December 1877, who sold it to Sarah Weeks, wife of James Weeks, in January 1878. Joseph Weeks, as agent for his wife, sold the ground to Rachel Lux, Joseph's mother, a year later in January 1879. Near the end of her life, Rachael Lux wrote a will leaving control of her estate to her son John T. Lux. In December 1890, he sold her Mt. Washington property to Benjamin Brumley as shown below.

This indenture made an entered into the ninth day of December 1890 by in between John T. Lux of the first part and Benjamin Brumley of the second part, all of Mount Washington, county of Bullitt and state of Kentucky.

Witnesseth that the party of the first for and in consideration of the sum of $1000 to be paid as follows: $609.50 cash in hand paid, the receipt whereof is hereby acknowledged, and $340.50 to be paid on the 17th day of February 1892, bearing 6% interest from the 17th day of February 1890 until paid; and $50 to be due and payable to F. P. Straus on the 17th day of February 1892 bearing 6% interest from the 17th day of February 1890 until paid. For the deferred payments the second party execute his notes for which a lien is retained to secure the payment of; has this day bargained and sold and by these presents doth grant, bargain and sell, release and convey unto the second party, his heirs and assigns, a certain house and lot or parcel of land lying in Mt. Washington, Kentucky fronting on Main Street in said town, it being part of Lot No. 74 fronting on Main Street 61 feet and running back to South Street or Spring Street parallel with the line of Lot No. 78 to Spring or South Street, thence with the same and fronting on the same 61 feet to the corner of Lot No. 70, thence with the line of the same to Main Street, and is that part of said Lot No. 74 in said town on which the residence of the late Elizabeth Hall stood.

Also part of lot lying on the south side of Main Street fronting on said street 84 feet and 10 inches, and known on the town plat as Lot No. 78, running back from Main Street 247 feet, 6 inches.

Also part of Lot No. 74 front on said Main Street 23 feet 7 inches, running back 247 feet, 6 inches, the whole fronting on Main Street 108 feet 5 inches, and being the same property conveyed to J. F. Lux by W. W. Hall and wife as shown in Deed Book T, page 58, and afterward conveyed by J. F. Lux to James Weeks and wife, and by said James Weeks to Rachael Lux, deceased, and by the will of the said Rachael Lux, deceased, and a judgment of the Bullitt Circuit Court construing said will said title to the foregoing property passed to the first party; for particulars see judgment of court in the clerk's office of the Bullitt Circuit Court.

To have and to hold the same with all and singular the appurtenances thereto belonging or in any wise appertaining thereto to the second party, his heirs and assigns forever by this his deed of general warranty.
