Rachael Lux's Will - 1889

Racheal Lux, widow of John D. Lux, left her estate in the hands of her son John T. Lux with the apparent understanding that if any of her other children needed assistance, John would provide it.

State of Kentucky, County of Bullitt, Town of Mt. Washington.

To all persons whom it may concern, and to everybody. Be it known that the words, lines and sentiments which are written in this document are my last will and testament.

I do make and declare my son John T. Lux the sole heir of all my property in this world, consisting of house and land, household and kitchen, furniture, and all the appurtenances therein and thereon, all stock of any kind now belonging to me, all fowls, all moneys, notes, deeds, policies &c.

And that he my son John T. Lux is to have full control of everything at my death, and that he John T. Lux is to support, maintain, comfort and take care of my daughter Cynthia A. Lux during the time that she may live; and that she is .. to the use of all things about the house and premises for her own comfort, and that may be necessary for her wants and enjoyment.

It is the desire ofmy son John T. Lux that in case his sister and my daughter Mrs. Emily Cunningham should become destitute and without protection that she shall or can have shelter and protection under his roof and his care, and his kindness, and his help, and his desire in her case is my will.

It is also the desire of my son John T. Lux that in case his brother and my son Joseph F. Lux should become afflicted or unfortunate in any way that he could not make a support for himself that he also shall or can have shelter under his roof and share his help and kindness, and the desire of my son in this case is also my will.

It is the desire of my son John T. Lux that it may be a home for any of his sisters and his brothers so long as he lives, and this desire is also my will.

I declare this will shall go into execution immediately after my death. Given under my hand and seal this 28th day of April A.D. 1888. (signed) Racheal [her x mark] Lux

State of Kentucky, Bullitt County, Sct. I E. W. Hall, clerk of the Bullitt County Court in the state of Kentucky, certify that on the 11th day of November 1889 the foregoing will of Rachael Lux dec'd was filed in open court, and proved by the oath of H. F. Crenshaw, a subscribing witness thereto, to have been signed and executed by said Rachael Lux to be her last will and testament in his presence and in the presence of W. S. McFarland, the other subscribing witness to same, and that they attested same in her presence at her request and in the presence of each other, and that the said Rachael Lux was at the time of executing the same of sound mind and memory, and the same being fully proved as required by law was ordered to be recorded which with this certificate I have truly recorded in my office this 30th of November 1889.
