Jonathan Simmons to Wilford Lee - Part of Shepherdsville Lot 57

Benjamin Summers purchased two-thirds of lot 57 (new plan) from Adam Shepherd. This includes all of the lot on this drawing except the part labeled D. On 6 Apr 1821, he sold the part labeled "A" to Henry C. Jones. At this time it appears that John W. Beckwith has a storehouse on the part labeled "E". Summers next, on 28 Apr 1821, sold the part labeled "B" to Richard P. Simmons, and the part labeled "C" to Nathan and Walter B. Miles. He next sold the part labeled "E" to Jonathan Gore Jr. The part labeled "D" was sold by the trustees to Thomas Joyce in 1832.

On 22 Oct 1827, the Miles tract was sold to Jonathan Simmons via a court-ordered sheriff's sale. Simmons then sold it to Wilford Lee, as shown below.


Bullitt County Deed Book F, Pages 405-406

This indenture made this 29th day of October 1827 between Jonathan Simmons and Sarah his wife of the county of Bullitt and state of Kentucky of the one part and Wilford Lee of the same county and state of the other part.

Witnesseth that the said Jonathan Simmons and Sarah his wife for and in consideration of the sum $1200 to them in hand paid before the sealing and delivery hereof, the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these presents do grant, bargain and sell, alien, release, convey and confirm unto the said Wilford Lee, his heirs &c a certain part of lot No. 57 in the town of Shepherdsville on which lot there is a brick dwelling house and out house, being the same part of said lot which was conveyed by Benjamin Summers and wife to Nathan and Walter B. Miles, and by the sheriff of Bullitt County to the said Jonathan Simmons, reference being had to the said deeds recorded in the clerk's office of the Bullitt County court will more fully appear.

To have and to hold the said part of lot No. 57 and appurtenances unto him the said Wilford Lee, his heirs &c free and clear of and from all right and title of dower or other encumbrances, and to his and their only proper use, benefit and behoof forever, and the said Jonathan Simmons and Sarah his wife for themselves, their heirs &c do covenant and agree to and with the said Wilford Lee, his heirs &c that they will and their heirs shall warrant and forever defend the said part of said lot unto him the said Wilford Lee, his heirs &c from themselves and their heirs, and all persons claiming or to claim the same. And Nathan Miles and Rhoda his wife join in this conveyance and do hereby convey and relinquish all claim, right, title and interest either equitable or legal which they possess in the said part of said lot to the said Wilford Lee, his heirs &c, the said Rhoda also relinquishing her right of dower in the same. And the said Nathan Miles and William Simmons and Moses Miles join in this deed of conveyance as security to said Wilford Lee for the title to the said part of of said lot hereby conveyed, and do covenant with him the said Lee to defend the title against the claim or claims of all persons whatever.

In testimony whereof the said Jonathan Simmons and Sarah his wife, Nathan Miles and Rhoda his wife, William Simmons and Moses Miles hereunto set their hands and seals on the day and year before written.
