Wilford Lee - Division of Real Estate

On 3 Mar 1851, the heirs of Wilford Lee, dec'd, signed an an article of agreement in which they divided his real estate amongst themselves, as shown below. As a part of this division, Mary Lee White and her husband Jenus [James] White received Wilford Lee's remaining holdings in the town of Shepherdsville, including lot No. 42; the old jail on part of Lot No. 24 purchased by Wilford Lee of Frederick Travis; the Old Brick house situated on part of Lot No. 57, being the same conveyed to Wilford Lee by Nathan Miles; and Lot No. 37.

Article of Agreement and conveyance made and entered into on the 3rd of March 1851 between H. I. Craycroft and Eliza his wife of the city of Louisville and state of Kentucky on their own behalf, and the said H. I. Craycroft as attorney in fact for Matilda Ann Simmons of the state and city aforesaid, and Charles Lee on his own behalf and Letitia his wife, and as attorney in fact for Jenus [James] White and Mary his wife and Atkin Lee and Susan his wife, and Benjamin Harned and Ellen his wife, and John Swank and Sarah his wife, and Philip Q. Lee all of the state of Kentucky as follows, to-wit. Whereas all of the above parties have in their own rights and as attorneys aforesaid this day entered into the following division of the real estate of Wilford Lee, deceased.

First, Charles Lee as the attorney of Atkin Lee and John Swank and Sarah his wife, are to have all of that tract of land on the south side of Salt River containing __ acres and known by the name of the Old Brick House tract and situated on the waters of Crooked Creek, and including what is called the Medley Tract to be equally divided between the said Charles Lee as attorney for Atkin Lee and John Swank and wife.

2nd. Benjamin Harned and Ellen his wife are to have all of the land on the south side of Salt River included in what is called the Obriant and Crigler tracts, the Obriant tract being the same conveyed to Wilford Lee by James Combs, and the Crigler tract being the same conveyed to the said Wilford Lee by Abraham Crigler, both of which deeds are now of record in the Bullitt County Court clerk's office.

3rd. Charles Lee in his own right is to have all the land on the south side of Salt River included in what is called the Friddle Tract and the Mill Tract; the Friddle Tract being the same conveyed to Wilford Lee by Jacob Friddle, and the Mill Tract being the same conveyed to said Lee by Nathan Harris, which deeds are also of record in the Bullitt County Court clerk's office.

Fourth. Philip Q. Lee is to have the house and lot on 5th Street in the city of Louisville situated between Green and Walnut Streets, being the same conveyed to Charles Lee, H. I. Craycroft and James W. Simmons by Henry Phillips, which deed is now of record in the Jefferson County Court clerk's office.

5th. H. I. Craycroft and Eliza his wife are to have what is called the Green Street house and lot in the city of Louisville situated between 4th and 5th Cross Streets, and being the same conveyed to Wilford Lee by R. & E. Crutchfield, which deed is also of record in the Jefferson County Court clerk's office.

6th. Jenus White and Mary his wife are to have all the houses and lots in the town of Shepherdsville, to-wit, Lot No. 42; the old jail on part of Lot No. 24 purchased by Wilford Lee of Frederick Travis; the Old Brick house situated on part of Lot No. 57, being the same conveyed to Wilford Lee by Nathan Miles; and Lot No. 37 conveyed to Wilford Lee by Marshall Halbert.

7th. Matilda Ann Simmons in lieu of her share of the land is to have the sum of fifteen hundred dollars, eight hundred dollars of which is this day paid and secured to be paid her by Philip Q. Lee; two hundred dollars of which is this day paid by Charles Lee as attorney for Atkin Lee; two hundred dollars of which is paid by H. I. Craycroft, her attorney in fact; the receipt of which said several sums is hereby acknowledged; and in consideration whereof the said Matilda Ann Simmons does by her said attorney H. I. Craycroft convey all her right, title and interest in and to all the real estate herein mentioned to those to whom it is above allotted.

To have and to hold her said interest in and to said above mentioned shares of real estate to them and their heirs forever. And the said Matilda Ann does by her said attorney warrant and defend the title to said described real estate by general warranty deed &c.

And in consideration of the above just and equal division of the above described real estate each and all of the parties to these presents doth grant, bargain, sell and convey all of the real estate not hereby allotted to each individual from one to another and to their and their heirs forever by general warranty deed. Benjamin Harned has received fifty dollars of Philip L. Lee, and fifty dollars of Charles Lee which makes his portion of the above land equal to fifteen hundred dollars which the share of each heir of Wilford Lee in and to said real estate is this day estimated at. In testimony whereof the parties to these presents have hereunto set their hands and seals the day and year above written.
