Weir Tilford and Abraham Field Jr. to Jacob Bowman - Lots 45 & 46

On 27 Jun 1797, Benjamin Summers bought ten lots. Listed here are the lot numbers in the new plan and in parentheses the number in the old plan: Lots 41 (13), 42 (14), 21 (24), 45 (41), 46 (42), 47 (43), 48 (44), 64 (45), 63 (46), 79 (51). Summers then sold lots 45 and 46 to George Saunders on 16 May 1821. Then George sold the two lots to Thomas Sanders Sr. Thomas next sold these two lots to Weir Tilford and Abraham Field Jr. on 15 Jan 1823. In October 1827 Tilford and Field deeded the lots to Jacob Bowman, as described below. Jacob Bowman's heirs sold the lots to James Doyle in April 1844.

This indenture made the 17th day of October 1827 between Weir Tilford and Joseph Bowman, late merchants trading under the firm of Tilford & Bowman of the county of Bullitt and state of Kentucky the one part and Jacob Bowman of the same county and state of the other part.

Witnesseth that said Weir Tilford and Joseph Bowman for and in consideration of the sum of one dollar and the conditions hereafter mentioned have granted, bargained, and sold, and by these presents do grant, bargain and sell, alien, release, convey and confirm unto the said Jacob Bowman, his heirs &c all the right, title and interest of the said Weir Tilford and Joseph Bowman of, in and to the lots and tanyard thereon in the town of Shepherdsville now in the occupancy of Field and Tilford together with the stock on hand now in the yard and all things belonging or appertaining to the said tanyard. Also the said Weir Tilford's right, title and claim to the following negro slaves, to-wit: Lucinda, aged about 30 years; Peter, aged about 26 years; Bill, aged about 13 years; and Nathan, aged about 10 years; and the said Tilford's right, title and claim to a lot and the improvements thereon in the town of Lancaster in Garrard County, Kentucky; also the said Joseph Bowman's right, title and claim to a lot in the town of Shepherdsville adjoining George W. Jenkins.

To have and to hold the above described real and personal property to him the said Jacob Bowman, his heirs &c forever free and clear of and from the claim of all persons whatever.

Provided nevertheless and these presents are on this condition that whereas the said Jacob Bowman and Weir Tilford were once partners in merchandize under the firm of Weir Tilford & Co. during the continuance of which a debt was contracted to one Wilford Lee and a note executed by the said W. Tilford and J. Bowman for $500, which debt with interest thereon is yet due. Also a debt to the United States Bank of about $925 which sum or thereabouts is now due, and owing and the said Jacob Bowman held a note on the said Weir Tilford and Joseph Bowman for $4000 dated 3rd day of February 1820 payable one day after date on which a note, interest is to be calculated from the 4th day of February 1820 until paid.

Now if the said Weir Tilford and Joseph Bowman shall well and truly pay and satisfy the said Jacob Bowman, his heirs &c the said sum of $4000 with the interest thereon as aforesaid until paid on or before the expiration of six months from the date hereof and the said Weir Tilford shall well and truly save and keep harmless the said Jacob Bowman, his heirs &c from the payment of the debts as aforesaid due by the firm of W. Tilford & Co. and from any responsibility therefore, then these presents shall cease and become utterly null and void, and the real and personal property hereby conveyed shall be reconveyed to the said Weir Tilford and Joseph Bowman, their heirs &c, anything herein contained to the contrary notwithstanding.

In testimony whereof the said Weir Tilford and Joseph Bowman hereto set their hands and seals on the day and year before written.
