H. O. Maraman to R. J. Meyler & Wesley Phelps

Benjamin Summers and George W. Jenkins had jointly purchased Shepherdsville lot #55 from Edward and Elizabeth Crow on 7 Aug 1824. Then Summers sold his share of the lot to Abraham Field. Field and Jenkins later divided the lot between them; and Jenkins sold his part to Alonzo S. Burleigh on 8 Apr 1851. Burleigh sold it to Bach and Herzog of Louisville. They would later sell it to Henry O. Maraman. Then, in 1879, in a court suit brought by R. J. Meyler and Wesley Phelps against Maraman for debt, the ground was sold at auction to them, as shown below.

Whereas on the 25th March 1879 a petition in equity was filed in the Bullitt Circuit Court of Kentucky by R. J. Meyler and Wesley Phelps against H. O. Maraman & E. E. Maraman his wife seeking a judgment to sell the property hereinafter conveyed in satisfaction of debts due said plaintiffs and on the 11 April 1879 the court rendered such judgment and directed its master commissioner to execute same and on the 23 June 1879 said commissioner filed his report of sale which was confined by the court on this day, And it appearing from said report that the master commissioner persued the directions of said judgment as to advertising the property line, place and terms of sale and on Monday May 19th 1879 at the courthouse door in Shepherdsville, Bullitt County, Kentucky the time and place advertised for the sale he offered same to the highest bidder when R. J. Meyler and Wesley Phelps being such bidders bought the Herzog and Batch lot at $67 and the other lot at $500, and being owners of the judgment no bond was taken of them, and it appearing that the property bought more than two-thirds of its appraised value, the court on this day directed the master commissioner to convey same to the purchaser.

This indenture witnesseth that in consideration of the premises and said sums of money, H. O. Maraman and E. E. Maraman his wife by R. McConathy, master commissioner, Bullitt Circuit Court, doth convey unto R. J. Meyler and Wesley Phelps to hold as joint tenants all their title including dower and homestead rights to the property purchased by them as aforesaid to wit.

1st, a lot of ground situated on corner of Main and Water Streets where H. O. Maraman [resides?] in town of Shepherdsville, Bullitt County, Kentucky.

2nd, a lot of ground 100 x 82.5 feet adjoining the above on Water Street and School Alley bought by H. O. Maraman of Batch & Herzog and being part of lot No. 55 in said town together with all the appurtenances on said lot on the 19th May 1879.

In pursuance to an order of the court this day entered in said cause it is provided that R. J. Meyler have a lien on the half interest of Wesley Phelps in the lots and appurtenances herein conveyed to secure him in the sums of $45.39 with interest from 19th May 1879 until paid and $37.85 with 10% interest per annum from 19th May 1879 until paid this in order to equalize them in their respective interests in this purchase. Witness the hand of the master commissioner on behalf of the grantors this 25 June 1879.
