Wilford Lee to Joseph Saunders - Part of Shepherdsville Lot 41

In 1826, Noah C. Summers deeded several town lots to Sydney S. Alexander who had purchased them a year earlier and had them deeded to Summers. The lots included 26, 41, 42, 47 and 63. Then on 2 Oct 1827, Alexander joined with Benjamin Summers in selling lots 47 and 48 to Thomas Q. Willson. And on 15 Aug 1828, Alexander, by a quit claim deed, sold his title to lots 41 and 42 to Jonathan Gore Jr. as shown below. On 20 Nov 1832, Gore sold part of lot No. 42 to Wilford Lee; and then on 12 Aug 1833, he sold part of lot No. 41 also to Lee who later sold that part of lot No. 41 to Joseph Saunders.


Bullitt County Deed Book H, Pages 74-75

This indenture made this 26 day of May 1834 between Wilford Lee and __ his wife of the county of Bullitt and state of Kentucky of the one part and Joseph Saunders of the same county and state of the other part.

Witnesseth that the said Wilford Lee and his wife, for and in consideration of the sum of $160 current money of the United States to them in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold and by these presents do grant, bargain and sell, alien, release, convey and confirm unto the said Joseph Saunders, a certain piece or part of lot number 41 in the town of Shepherdsville and bounded as follows, to-wit.

The north corner of said lot number 41 adjoining and east of the Public Square in said town and is the same on which stands a small log house formerly occupied by Jonathan Gore Jr. as a saddler's shop and now occupied by Frederic Travis as a tailor's shop, and is all that part of lot number 41. The quantity hereby conveyed is not precisely known, but is so much of said lot as would be stricken off of the same by a straight line running from the eastern post of a large gate that opens northward into the street into the corner of Matthew Wilson's plank fence on a part of said lot, the said line running nearly north and south.

To have and to hold said piece of said lot as above described with all the appurtenances thereto belonging unto the said Joseph Saunders, his heirs, executors and assigns, and to his and their are only proper use, benefit, and behoof forever. And said Wilfred Lee, and __ his wife for themselves, their heirs &c do covenant and agree to, and with the said Joseph Saunders that they will and their heirs shall warrant and forever defend the said described part of said lot number 41 with all the appurtenances unto him the said Joseph Saunders, his heirs and assigns from the claim or claims of all and every person or persons lawfully claiming or to claim the same.

In testimony, whereof the said Wilfred Lee and __ his wife hereto set their hands and seals on the day and year before written.

Memo: I Wilford Lee am not to be held liable personally to said Joseph Saunders in case the land and lot here sold is lost by any other or better claim. But I do hereby transfer to said Joseph Saunders, my recourse to Jonathan Gore, and others as will be seen by their deed to me of record in the Bullitt County Court office for th same lot and other parcels; also and any and all right of action secured to me in said deed is hereby transferred to said Saunders and he may sue and recover accordingly.
