George W. Miles to John B. Shepherd - 1 Acre

After John H. Baker & wife transferred ownership of the forge tract to Charles Quirey and James E. Tyler in 1845, Quirey and Tyler sold about 3 acres of it that adjoined Shepherdsville on the west and next to the graveyard to George W. Miles. Miles sold the acre closest to town to John B. Shepherd in 1849, as shown below. Following Shepherd's death, the tract was deeded by his heirs, via a court suit, to Lorenzo Hogland.

This indenture made this fourth day of April 1849 between George W. Miles and Minerva B. Miles of the county of Bullitt and state of Kentucky of the first part and John B. Shepherd of the aforesaid County and state of the second part.

Witnesseth that for and in consideration of the sum of $200 to be paid to the party of the first part, his heirs or assigns, that is to say $50 on or before the 4th day of October 1849, $50 on the 4th of April 1850, $50 on the 4th of August 1850, and the like sum of $50, being the last payment on the 4th day of December 1850, for which sums of money said J. B. Shepherd has executed and delivered to the aforesaid Miles his four promissory notes bearing even date with these presents and payable to the said George W. Miles, his heirs or assigns, the receipt of which is hereby acknowledged, hath given, granted, bargained and sold, aliened, released, conveyed and confirmed and by these presents doth give, grant, bargain and sell, alien, release, convey and confirm unto the said John B. Shepherd and to his heirs or assigns a certain lot of ground supposed to contain one acre together with the buildings and appurtenances thereof, situated and lying near the town of Shepherdsville in the County of Bullitt, it being a fourth part of a tract or parcel of land purchased of Quirey and Tyler by said Miles, and being the eastern lot, beginning at the corner of the plank fence at a road and in the western boundary line of said town, thence with said line North 7 1/2° East 22 8/10 poles to a stone being the southeast corner of the grave yard lot, and thence to the fence of W. Merrifield, thence to the plank fence near the road and thence to the beginning.

To have and to hold the said lot or parcel of land unto him the said John B. Shepherd and to his heirs and assigns forever. And the party of the first part hereby covenants and agrees to and with the party of the second part and with his heirs and assigns that he will forever warrant and defend the said lot or parcel of land and appurtenances herein described unto him the said party of the second part, his heirs or assigns against the claims of all persons whatever lawfully claiming the same. And a lien is hereby retained upon the said lot &c to secure the payment of the notes herein before mentioned, and the party of the second part is not to sell, lease or rent the above described lot to any person or persons except those who may be in the employe of the Shepherdsville Iron Manufacturing Company without the written consent of said company and the following priviso between the parties aforesaid is hereby agreed on and form a part of this indenture. That should the party of the second part remove from Shepherdsville or its vicinity in the course of one year from the date of these presents, should he desire it, he is to have the privilege of reconvey to the party of the first part said described lots &c, the party of the second part forfeiting to the party of the first part the first payments and such improvements as may be added by the party of the second part, and the party of the first part binds himself to surrender to the party of the second part the three unliquidated notes held in consideration of the aforesaid named purchase.
