John H. and Nancy Baker to Quirey and Tyler, 1845

On 24 Jan 1845, the Bakers transferred to Quirey and Tyler their ownership of the forge tracts and related property as well as the land obtained from William Pope which included the Salt River furnace.

This indenture made this 24th day of January 1845 between John H. Baker and Nancy D. his wife of the county of Bullitt in the state of Kentucky of the one part and Charles Quirey and James E. Tyler of the other part. Witnesseth that the said Baker and wife for and in consideration of the debts and liabilities which said Baker owes to and is under to said Quirey and Tyler and other valuable considerations, all of which said Quirey and Tyler do hereby acknowledge, said Baker and wife have granted, bargained and sold, aliened, released, enfeoffed, conveyed and confirmed, and by these presents do grant, bargain and sell, alien, release, enfeoff, convey and confirm unto said Quirey and Tyler and to their heirs and assigns forever three certain tracts or parcels of land situate, lying and being in the county of Bullitt and state of Kentucky, one containing fifty acres, another containing 150 acres, and the other 250 acres, be the quantity more or less in each tract on which the forge on Salt River near Shepherdsville is situate and which are included in the mortgage from said Baker to said Quirey and Tyler and also the said Baker's part of the land bought by him and Thomas Joyce of John Pope and wife by deed now in the clerk's office of the Bullitt County Court and including thereon the Salt River Furnace and all other improvements thereon and said Baker doth hereby sell and convey to the said Quirey and Tyler all the personal property and estate included in said mortgage from said Baker to said Quirey and Tyler, and said Baker also sells and transfers to said Quirey and Tyler all claims for on account of the Holsclaw agency and the Lane agency and of the Redd agency and also all claims to an account of the use and occupation of the forge property and of the Salt River furnace property, and all other the mortgaged estate up to this day; and said Baker doth hereby see and convey to said Quirey and Tyler all the personal estate and property now on hand at the forge and furnace or procured in any way for the prosecution of said forge and furnace except that portion of the personal estate included in said mortgage, and which now in said Baker's possession at the Crooked Creek furnace and all the estate right, title, interest, claim and fee of the said Baker and wife of, in and to the same in any and all respects.

To have and to hold unto the said Quirey and Tyler and their heirs and assigns to their only proper use, benefit and behoof forever, free from any and all right of redemption on the part of the said Baker and wife, and said Baker and wife do covenant and agree to and with said Quirey and Tyler and with their heirs and assigns that they will and their heirs, executors and administrators shall warrant and forever defend the property herein and hereby conveyed unto said Quirey and Tyler and to their heirs and assigns forever against all and every person or persons whatever lawfully claiming or to claim the same by, from, through or under him but not otherwise and this deed is to be held and taken and considered as a deed of quit claim and release only on the part of said Baker and wife.
