Richard P. Simmons' Heirs to Henry J. Craycroft - Part of Lot 25

On 6 Oct 1821, James J. Dozier sold a part of Shepherdsville lot #25 to Edward McDade who sold it to Richard P. Simmons.

Simmons' heirs would later sell the ground to Henry J. Craycroft as shown below. This was the northernmost 40 feet of lot 25. Craycroft would later sell it to Wesley Phelps.

This indenture made this 12th day of October 1846 between Nicholas Simmons, Alfred Simmons, Jacob W. Bowman and Mary Jane his wife, Solomon N. Brooks and Elizabeth his wife, Richard H. Field, Alfred J. Field and Abraham Hamlet Field, heirs of Richard P. Simmons, dec'd by Noah C. Summers commissioner for them for that purpose of one part, and Henry J. Craycroft of the second part.

Witnesseth that whereas the said heirs of Richard P. Simmons dec'd filed their petition in the Bullitt Circuit Court, praying a sale of the real estate of said R. P. Simmons dec'd agreeably to law, and said court did by its order and decree in said cause of 10 April 1846 direct and appoint Henry C. Thomas commissioner to make sale of said real estate of said decedent as therein named and report the sales to court. And said commissioner Thomas did as by said decree directed sell said real estate of said R. P. Simmons dec'd on 18 May 1846 and among other estate sold said Henry J. Craycroft purchased a house and lot in the town of Shepherdsville on Main Street and on the alley between the said lot and the jail and courthouse lot in the new plan of Shepherdsville. The said lot so sold is part of lot number 25 in the new plan of the town of Shepherdsville fronting on Main Street about 40 feet and extending back at right angles with the alley about 99'5" for the sum of $172.

And said commissioner returned his said report of sales to the Bullitt Circuit Court at the October term 1846, and said report and sales were confirmed by the order and decree of said court; and said court appointed Noah C. Summers a commissioner to make to said purchasers a deed for the property purchased on the part of the said Richard P. Simmons' heirs.

Now therefore in consideration of the premises, the said decree, sales and orders in the cause, they the said parties of the first part, heirs of Richard P. Simmons dec'd by Noah C. Summers commissioner for them for that purpose, have sold conveyed and confirmed, and by these presents do sell, convey and confirm unto him the said Henry J. Craycroft and to his heirs and assigns forever the said part of lot No. 25 in the new plan of Shepherdsville aforesaid with its appurtenances.

To have and to hold the said part of lot No. 25 with its appurtenances aforesaid unto him the said Henry J. Craycroft and to his heirs and assigns forever against the claim or claims of them the said Richard P. Simmons's heirs, parties of the first part herein and their heirs and assigns forever as fully as by law the decrees and orders in said cause the title can be warranted to said lot and appurtenances without any individual responsibility on said commissioner. Witness the hands and seals of the grantors the date first herein written.
