Heirs of R. P. Simmons to Nicholas Simmons - Parts of Shepherdsville Lots 39 & 40

Following the death of Richard P. Simmons, his heirs petitioned the court to sell his estate. Of the pieces sold was a part of Shepherdsville lots 39 and 40, then known as the brick tavern lot which was sold to Simmons' son Nicholas Simmons as shown below.

Richard P. Simmons had purchased the lots from Wilford W. Maraman on 21 Aug 1841. Nicholas Simmons deeded the ground to his grandchildren in 1874.

This indenture made this 12th day of October 1846 between Nicholas Simmons, Alfred Simmons, Jacob W. Bowman and Mary Jane his wife, Solomon N. Brooks and Elizabeth his wife, Richard H. Field, Alfred J. Field and Abraham Hamlet Field, heirs of Richard P. Simmons dec'd by Noah C. Summers, commissioner appointed for them for that purpose of the one part, and Nicholas Simmons of the other part.

Witnesseth that whereas the said heirs of Richard P. Simmons dec'd filed their petition in the Bullitt Circuit Court praying a sale of the real estate of said Richard P. Simmons dec'd agreeably to law, and said court did by its order and decree in said court of the 10th of April 1846 direct and appoint Henry C. Thomas commissioner to make sale of the real estate of said decedent as therein named and report the sales to court, and said Henry C. Thomas, commissioner, did as by said decree directed sell said estate of said R. P. Simmons dec'd on the 18th May 1846, and amongst other estate sold, said Nicholas Simmons purchased the houses and lots of ground in the town of Shepherdsville called the brick tavern, composed of parts of lots Nos. 39 & 40 in the new plan of said town, and is more particularly described in the deed from W. W. Maraman to said R. P. Simmons dated the 21 August 1841 and the deeds therein referred to said deed is recorded in the Bullitt County Court clerk's office in deed book I, page 413, reference thereto had will will show, for the sum of $2800, and said commissioner returned said report and sales to the Bullitt Circuit Court at the October Term 1846 and said report and sales were confirmed by the order and decree of said court; and said court appointed N. C. Summers commissioner on the part of said R. P. Simmons' heirs to convey the said lots and appurtenances so sold to the said Nicholas Simmons.

Now therefore in consideration of the premises, the said decree, sales and orders in the cause, they the said parties of the first part, heirs of Richard P. Simmons dec'd, by the said Noah C. Summers, commissioner for them for that purpose, have sold, conveyed and confirmed and by these presents do sell, convey and confirm unto him the said Nicholas Simmons in consideration of said $2800, and to his heirs and assigns forever the said parts of Lots Nos. 39 & 40 with the appurtenances to the same belonging or in any wise appertaining.

To have and to hold the said parts of lots Nos. 39 & 40 with their appurtenances as aforesaid unto him the said Nicholas Simmons and to his heirs and assigns forever against the claims of them the said heirs of Richard P. Simmons dec'd, parties of the first part herein and against their heirs and assigns forever, and against all other persons as fully as by law and the orders and decrees &c in the cause said commissioner can warrant title without and individual liability on said commissioner. Witness the hands and seals of the grantors, the date first herein written. (signed by the grantors)
