Preston N. Hornbeck to Matthew Wilson - 140 Acres

On 2 Dec 1839, three descendants of Samuel Hornbeck (Isaac, Preston N., and John C.) each sold land to Matthew Wilson. Below is the deed for 140 acres from Preston N. Hornbeck.

This indenture made this second day of December in the year of our Lord one thousand eight hundred and thirty-nine between Preston N. Hornbeck and Mary J. his wife of the County of Bullitt and Commonwealth of Kentucky of the one part, and Matthew Wilson of the City of Louisville, County of Jefferson and State aforesaid of the other part. Witnesseth that the said Preston N. Hornbeck for and in consideration of the sum of $4,200 paid as follows, $1373.29 in hand paid and $2826.71 in twelve months without interest, the receipt of which is hereby acknowledged, they the said Preston N. Hornbeck and wife have sold and by these presents do sell and convey unto the said Matthew Wilson the following tract or parcel of land situate, lying and being in Bullitt County on the waters of Floyd's Fork of Salt River containing 140 acres more or less, and being part of a tract of 408 acres of land on which Samuel Hornbeck lived and died, and bounded as followeth.

Beginning at the southeast corner of Hornbeck tract, thence North 1/2° East 49 poles, 18 links to the southeast corner of J. C. Hornbeck land, thence North 89° West 64 poles to a stake, another of John's corners, thence NOrth 1/2° East 51 poles to a stake, another of John C. Hornbeck's corners, thence North 88° West 52 poles to a stake, corner to John C. and Isaac Hornbeck, thence South 85°45' West 147 poles to two sycamores on the bank of Brooks' Run and near to John Anderson's gate, thence South 10° East 78 poles to a mulberry and water beech on the bank of Brooks' Run and between said run and a high cliff, thence South 42° West (for 50°) 21 poles and 18 links to a sugar tree on the bank of said run, thence South 44° East (for 45°) 5 poles to a stone on said branch and stopped short of a white oak marked as a corner two poles, ten links, thence East 253 poles to the beginning, being the same land conveyed to said P. N. Hornbeck by Isaac and John C. Hornbeck and conveyed by deed dated 22nd November 1839.

The foregoing land is here sold by the acre at $30 per acre. Together with all and singular the appurtenances thereunto belonging or in any wise appertaining. To have and to hold the land and appurtenances here conveyed unto him the said Matthew Wilson and to his heirs or assigns forever. And the said Preston N. Hornbeck for himself, his heirs, executore and administrators does hereby covenant and agree to and with te said Matthew Wilson that he the said P. N. Hornbeck and wife will, and their heirs, executors and administrators shall warrant and forever defend the title to the land and appurtenances here sold unto him the said Matthew Wilson and to his heirs and assigns against the claim or claims of them the said Preston N. Hornbeck and wife and their heirs and against the claims of all other persons whatever, and the said Hornbeck further covenants to and with said Wilson that they the said P. N. Hornbeck and wife have good right and title to and full authority to sell and convey the land and appurtenances herein named. In testimony whereof the said Preston N. Hornbeck and wife have hereunto set their hands and seals the date first herein written. (signed) P. N. Hornbeck, Mary Jane Hornbeck.

State of Kentucky, Bullitt County, to wit I Noah C. Summers, clerk of the county court for said county, certify that this deed from P. N. Hornbeck and wife to Matthew Wilson was on the 2nd day of December 1839 produced to me in said county and acknowledged by said P. N. Hornbeck to be his act and ddeed. And she the said Mary Jane Hornbeck, being by me privily examined separately and apart from her said husband as the law requires, declared that she did freely and willingly seal and deliver the said writing and make not to retract it, and agains acknowledged said writing fully read and explained to her to be her voluntary act and consented that the same might be recorded. Whereupon I have truly recorded said deed in my office together with this certificate this 13 day of February 1840. Att. Noah C. Summers, C.B.C.C.
