Isaac Hornbeck to Matthew Wilson - 153 Acres

On 2 Dec 1839, three descendants of Samuel Hornbeck (Isaac, Preston N., and John C.) each sold land to Matthew Wilson. Below is the deed for 152 acres from Isaac Hornbeck.

This indenture made this second day of December in the year of our Lord one thousand eight hundred and thirty nine between Isaac Hornbeck and Mary M. his wife of the County of Bullitt and State of Kentucky of the one part and Matthew Wilson of the City of Louisville, County of Jefferson and State aforesaid of the other part. Witnesseth that the said Isaac Hornbeck for and in consideration of of the sum of four thousand five hundred and ninety dollars payable as follows, fifteen hundred and thirty dollars in hand paid, and three thousand and sixty dollars payable in two years without interest, the receipt of which is hereby acknowledged, they the said Isaac Hornbeck and Mary M. his wife have sold, and by these presents do sell and convey unto the said Matthew Wilson the following tract or parcel of land in Bullitt County on the waters of Floyd's Fork of Salt River (being part of a tract of 408 acres of land on which Samuel Hornbeck dec'd live and died) containing 153 acres, more or less, and bounded as follows, to wit.

Beginning at John C. Hornbeck's corner in the lane between Hornbeck and Summers, thence North 88° West 174 poles to a stone marked I.A. and on the east bank of Brooks' Run, thence South 24° East (for 24 3/4°) 56 poles to a fallen white oak, red oak and black walnut near a cliff of rock and cave on Brooks' Run, thence South 4 1/2° West (for 2°) 30 poles to a stone, thence South 25° East (for 27 1/2°) 18 poles to a stone, thence South 9° West (for 8°) 31 poles to __ and black oak and hickory, thence South 10° East 24 poles to two sycamores on he bank of Brooks' Run and near John Anderson's gate, thence North 85°45' East 147 poles to a stake the southeast corner of John C. Hornbeck's tract, thence with his line North 1/2° East 133 poles to the beginning, being the same land conveyed to said Isaac Hornbeck by John C. Hornbeck and P. N. Hornbeck and wives by deed dated 22 of November 1839.

The land herein sold is by the acre at $30 per acre. Together with all and singular the appurtenances thereunto belonging or in any wise appertaining. To have and to hold the land and appurtenances here conveyed unto him the said Matthew Wilson and his heirs or assigns forever and the said Isaac Hornbeck for himself, his heirs, executors and administrators does hereby covenant and agree to and with the said Matthew Wilson that he the said Isaac Hornbeck wil and his heirs, executors and administrators shall forever warrant and defend the title to the land and appurtenances hereby conveyed unto him the said Matthew Wilson, his heirs or assigns against the claim or claims of them the said Isaac Hornbeck and wife and their heirs, and all other persons whatsoever. And they further covenant and agree to and with the said M. Wilson that they the said Hornbeck and wife have good right and title to and legal authority to sell and convey the land and appurtenances here sold. In testimony whereof the said Issac Hornbeck and wife have hereunto set their hands and seals the dat first herein written. (signed) Isaac Hornbeck, Mary M. Hornbeck

State of Kentucky, Bullitt County, to wit I Noah C. Summers, clerk of the county court for said county, certify that this deed from Isaac Hornbeck and Mary M. his wife to Matthew Wilson was on the 2nd day of December 1839 produced to me in said county and acknowledged by said Isaac Hornbeck to be his act and ddeed. And she the said Mary M. Hornbeck, being by me privily examined separately and apart from her said husband as the law requires, declared that she did freely and willingly seal and deliver the said writing and make not to retract it, and agains acknowledged said writing fully read and explained to her to be her voluntary act and consented that the same might be recorded. Whereupon I have truly recorded said deed in my office together with this certificate this 13 day of February 1840. Att. Noah C. Summers, C.B.C.C.
