John C. Hornbeck to Matthew Wilson - 115 Acres

On 2 Dec 1839, three descendants of Samuel Hornbeck (Isaac, Preston N., and John C.) each sold land to Matthew Wilson. Below is the deed for 115 acres from John C. Hornbeck.

This indenture made this second day of December in the year of our Lord one thousand eight hundred and thirty nine between John C. Hornbeck and Delia W. Hornbeck his wife of the county of Bullitt and Commonwealth of Kentucky of the one part, and Matthew Wilson of the City of Louisville, County of Jefferson and state aforesaid of the other part. Witnesseth that the said John C. Hornbeck for and in consideration of the sum three thousand four hundred and fifty dollars payable as follows, eleven hundred and fifty dollars on hand paid, eleven hundred and fifty dollars in twelve months without interest, and eleven hundred and fifty dollars in two years without interest, the receipt whereof is hereby acknowledged, they the said John C. Hornback and wife have sold and by these presents do sell and convey unto the said Matthew Wilson the following tract or parcel of land situate lying and being in Bullitt County on the waters of Floyd's Fork of Salt River containing one hundred and fifteen acres, more or less, being a part of the tract of four hundred and eight acres on which Samuel Hornbeck deceased lived and died, and bounded as follows, to wit.

Beginning at a stone marked S.H. the northeast corner of the Hornbeck land, thence North 88° (for West) West 117 poles to a stone in the lane and in a line between Hornbeck and Summers, thence South 1/2° West 133 poles to a stake, thence South 88° East 52 poles to a stone, thence South 1/2° West 51 poles to a stake, thence South 89° East 64 poles to a stake in the eastwardly line of Samuel Hornbeck dec'd tract of land, thence North 1/2° East 183 poles and 11 links to the beginning, being the same tract of land that was conveyed to said John C. Hornbeck by Isaac Hornbeck and Preston N. Hornbeck and their wives by deed dated 22nd November 1839.

The foregoing land where sold by the acre at $30 per acre. Together with all and singular the appurtenances thereunto belonging or in any wise appertaining. To have and to hold the land and appurtenances here conveyed unto him the said Matthew Wilson over to his heirs or assigns forever and the said John C. Hornbeck for himself, his heirs, executors and administrators does hereby covenant and agree to and with the said Matthew Wilson that he the said John C. Hornbeck will and his heirs, executors and administrators shall warrant and forever defend the title to the land and appurtenances here sold unto him the said Matthew Wilson and his heirs or assigns forever against the claim or claims of them the said John C. Hornbeck and wife and against the claims of all other persons whatsoever; and the said John C. Hornbeck does hereby further covenant and agree to and with the said Matthew Wilson that he the said John C. Hornbeck and wife have good right and title to and full authority to sell and convey the land and appurtenances herein mentioned. In testimony whereof the said John C. Hornbeck and wife have hereunto set their hands and seals the date first herein written. (signed) John C. Hornbeck, Delia W. Hornbeck.

State of Kentucky, Bullitt County, to wit
I Noah C. Summers, clerk of the county court for said county, certify that this deed from John C. Hornbeck and wife to Matthew Wilson was on the second day of December one thousand eight hundred and thirty nine produced to me in said county and acknowledge by said John C. Hornbeck to be his act and ddeed. And the said Delia W. Hornbeck, being by me privily examined separately and apart from her said husband as the law requires, declared that she did freely and willingly seal and deliver the said writing and make not to retract it, and agains acknowledged said writing fully read and explained to her to be her voluntary act and consented that the same might be recorded. Whereupon I have truly recorded said deed in my office together with this certificate this 13 day of February 1840. Att. Noah C. Summers, C.B.C.C.
