R. J. Meyler Estate to Wesley Phelps - Lower Forge Tract

In 1852, the Shepherdsville Iron Manufacturing Company contracted to sell the Forge Tract near Shepherdsville to Wilhite Carpenter. They completed the transaction with his final mortgage payment in April 1864. Carpenter then sold a portion of this tract to Henry O. Maraman in 1868. Then he sold the remainder to John R. and Joseph Chaddic in 1870. Joseph assumed responsibility for the purchase in 1872. Then in 1876 Joseph Chaddic sold the tract to R. J. Meyler. Then in 1885, in a court suit against Meyler's estate, this tract was sold to Wesley Phelps as shown below. Two years later Phelps sold the tract to E. W. Hall and F. P. Straus.

Bullitt County Deed Book Z, Pages 240-242

This indenture made this 2nd day of March 1885, William Dawson, Sheriff of Bullitt County, Kentucky of the one part and Wesley Phelps of the county aforesaid of the second part.

Witnesseth that whereas Robert Shanklin sued out of the clerk's office of the Bullitt Circuit Court a writ of fieri facias against the estate of R. J. Meyler for the sum of $160 debt with interest thereon at 6% per annum from 5th of January 1876 until paid; also $17 costs bearing date 13 December 1883 returnable 7th February 1884 mill of void court which fieri facias was directed and delivered to the sheriff of said county and said sheriff by virtue of the said fieri facias while in full force levied the same on a certain piece of land called the forge tract lying in Bullitt County on Salt River below Shepherdsville, and forming part of the bed of said river near to Shepherdsville, and bounded as follows.

Beginning at the corner of the fence on the west side of Water Street in Shepherdsville, corner to Lewellen Holsclaw's land, thence with the fence down Salt River below the forge house where the old stables stood, thence in a southward direction with the fence to the corner and continuing in the same direction to a point on Salt River 7 feet perpendicular height above low water mark, thence down the river to western corner of A. H. Field's forge tract, thence across the river with the original tract said as deed to Wilhite Carpenter by J. F. Bullitt, president of the Iron Manufacturing Company, thence up the river with the same line to a point opposite the beginning, thence across the river to the place of beginning; the estate of said R. J. Meyler.

And he failing to give bond and security for the payment of said debt, interest and costs, the sheriff aforesaid in pursuance of said writ and according to the law of said state having legally advertised and make known the same, and said land having been duly and according to law appraised by two disinterested house keepers of Bullitt County, and not related to either party to the action, and being first duly sworn, they appraised said piece of land at the sum of $200, said appraisement in writing and duly signed by said house keepers, to wit, J. H. Hays & J. C. Hays, did on 21st day of January 1884 at the court house door in Shepherdsvillee on the first day of a County Court for said county in said county expose to public sale the aforesaid piece of land with the appurtenances, and all the estate right and title and claim whatever of said R. J. Meyler in and to said bond and whereas the said Wesley Phelps did then and there bid the sum of $52 for said land, and no person bidding more, the said piece of land and appurtenances were in due manner and form openly struck off and sold to said Wesley Phelps for the said sum of $52, and the said R. J. Meyler failing to redeem said land as required by law in due time as so provided by law, now therefore to confirm said purchase to said Wesley Phelps so as aforesaid, made this indenture.

Witness that said William Dawson Jr., Sheriff of said County for an in consideration of the sum aforesaid, to wit $52, which with its interest said Phelps has fully paid upon his purchase bond given for said land bought as aforesaid, has given, granted, sold and conveyed and by these presents sell and convey to said Wesley Phelps and his heirs and assigns forever all that piece of land with its appurtenances in the county aforesaid above described.

To have and to hold the said piece of land and its appurtenances to the said Wesley Phelps and his heirs and assigns forever in as full and ample a manner as the said William Dawson Jr. by virtue of the authority aforesaid ought to convey the said land and appurtenances. In witness whereof I have hereto set my hand and seal as sheriff aforesaid the day and date first above written. (signed) William Dawson Jr., S.B.C.
