James Halbert to Henry Jones - 10 Acres

On 20 Nov 1816, Adam Shepherd sold 23 acres north of Shepherdsville to James Halbert and Henry Jones, but the deed was made just in Halbert's name. Then on 18 Jan 1819, Halbert sold four acres to Benjamin Hughes that was located just north of the northwest corner of Shepherdsville above lots 1-4. On 18 Jan 1819, Halbert transferred ownership of 10 of the 23 acres to Henry Jones as shown below. Then on 8 Nov 1819, Halbert sold another 4 acre tract to Henry and J. W. Jones.

Bullitt County Deed Book D, Pages 76-77

This indenture made this 18th day of January 1819 between James Halbert of Bullitt County and state of Kentucky of the one part and Henry Jones of the same county and state of the other part.

Whereas sometime in the year 1816 the said James Halbert and Henry Jones purchased from Adam Shepherd 23 acres of land near to and adjoining the town of Shepherdsville, which land for the convenience was conveyed by the said Adam Shepherd to the said Halbert by deed bearing date the 20th day of November 1816; and the said Henry Jones at this time desiring a deed for so much of said land as he was and is entitled to by said purchase, for that purpose this indenture.

Witnesseth that for and in consideration of the premises aforesaid, and the further sum of one dollar current money to him the said Halbert in hand paid by the said Jones, the receipt whereof is hereby acknowledge, the said Halbert hath granted, bargained and sold and by these presents doth grant, bargain and sell unto the said Henry Jone and his heirs forever all that part of the said 23 acres of land which is within the following bounds, to wit.

Beginning at a stake the most northeastwardly corner of Jacob Shawler's one acre tract running thence North 6 1/2° East 57 1/2 poles to stake, thence North 83 1/2° West about 27 poles to a stake, thence South 6 1/2° West 57 1/2 poles to a stake in the direction of the most eastwardly side of Plumb Street when extended, thence South 83 1/2° East about 27 poles to the beginning, supposed to contain 10 acres, be the same more or less.

To have and to hold the before described tract or parcel of land together with all and singular the improvements and advantages to the same belonging or in any wise appertaining unto the said Henry Jones and his heirs to and for his and their only proper use, benefit and behoof forever.

And they said James Halbert doth covenant, promise and agree to and with the said Henry Jones that he will and his heirs, executors and administrators shall forever warrant and defend the before described lot of land against the claim of himself and his heirs and all persons whatsoever claiming by, through or under him or them, but against no adverse claim, it being the intention of said Halbert to convey all the right which derived to the parties by purchase from Shepherd only. In witness whereof the said James Halbert hath set his hand and affixed his seal the day and year first above written. (signed) James Halbert
