David M. Bates to Joseph F. Birkhead - 5 Acres

On 20 Jan 1872, John L. O'Brian sold 10 acres adjoining Shepherdsville to W. W. Zazio. Zazio then sold half of it to David M. Bates on 10 Mar 1879. Bates sold that five acres to Joseph F. Birkhead on 1 Sep 1879, as shown below. Birkhead sold it to J. W. Tucker on 4 Mar 1885.

This indenture made and entered into this 1st day of September 1879 by D. M. Bates and Nannie W. Bates his wife of the first part and Joseph F. Birkhead of the second part, all of Bullitt County, Kentucky.

Witnesseth that the parties of the first part, in part consideration for a house and lot this day conveyed by said second party to said D. M. Bates of the first part situated in Shepherdsville, Bullitt County, Kentucky on 2nd Street, have this day granted, bargained and sold, and hereby convey unto the said Joseph F. Birkhead the following land and appurtenances valued at $500, situated in Shepherdsville, Bullitt County, Kentucky adjoining the Kalfus tanyard property on the east, the lands of G. W. Simmons & Mrs. M. A. Isaacs on the south, the Simmons property being the same lately purchased of Joseph Chaddic & wife, the lane leading from the Bullitt's Lick Road to George W. Simmons on the west, and the public dirt road known as Bullitt's Lick Road on the north, supposed to contain five acres, be the same more or less, together with the appurtenances thereunto belonging, being the same property conveyed to D. M. Bates by W. W. Zazio and wife on 10th March 1879.

To have and to hold the same unto the said party of the second part, his heirs and assigns forever. And the parties of the first part hereby covenant to warrant and defend the title to the land and premises hereby conveyed against all claims by general warranty.

The first parties are to receive the rent of said property until the 25th of December next in consideration of which they are to erect a good paling fence around the yard and make and hang two or more gates to said fence.
