Henry Barth to Henry O. Maraman - 57 Acres + Shepherdsville Lot 80

On 12 Nov 1847, Henry O. Maraman transferred 57 acres of land on the north side of Salt River near Shepherdsville and Shepherdsville lot #80 to Henry Barth. It specifically excluded one half acre of ground at Maraman's ferry landing on Salt River which he retained. Then in 1854, following a Circuit Court case, the land and town lot were sold back to Maraman as shown below.

This indenture made this 28th day of January 1854 between Henry Barth and Elizabeth Barth his wife of the first part and Henry O. Maraman of the second part, all of Bullitt County, Kentucky.

Witnesseth that the party of the first part for and in consideration of the sum of $1000 paid as follows. A decree in the name of said Maraman agains said Barth in the Bullitt Circuit Court had at October Term for including cost amounting to $586.65, and the further sum of $413.35 cash, amounting to $1000 as aforesaid, they the party of the first part hath released and conveyed and doth by these presents release and convey unto the party of the second part, his heirs and and assigns, a tract or parcel of land lying and being in Bullitt County and adjoining the town of Shepherdsville, and a half acre lot No. 80 in the new plan of the town of Shepherdsville, being the same property conveyed by said Maraman to said Barth by deed dated the 12th day of November 1847 and recorded in Deed Book L, page 217, Bullitt County Court, and the decree had at October Circuit Court 1853 in name of Maraman against Barth for $575 and costs is satisfied.

To have and to hold said land and town lot unto the said Maraman, his heirs and assigns, against the claim of the said Barth and wife, and all persons claiming by through or under them, and no further, the deed being intended as a deed of release and quit claim.

I Robert F. Samuels, clerk of the county court for said county, do certify that the foregoing deed from Henry Barth and Elizabeth his wife to Henry O. Maraman was on the 28th day of January 1854 produced to me in my office and acknowledged by the said Henry Barth and Elizabeth his wife and Henry O. Maraman to be their act and deed.
