Henry O. Maraman to Henry Barth - 57 Acres

This deed, written on 12 Nov 1847, transferred 57 acres of land on the north side of Salt River near Shepherdsville from H. O. Maraman to Henry Barth. It specifically excluded one half acre of ground at Maraman's ferry landing on Salt River which he retained.

This indenture made this 12 day of November 1847 between Henry O. Maraman and Elmira Maraman his wife of Bullitt County, Kentucky of one part and Henry Barth of same place of the other part. Witnesseth: That the said Henry O. Maraman and wife for and in consideration of the sum of five hundred and seventy dollars, paid and secured to be paid, the receipt whereof is hereby acknowledged, they the said H. O. Maraman and wife have sold and conveyed and by these presents do sell and convey unto him the said Henry Barth and to his heirs forever the following tract of land in Bullitt County, Ky. on Salt River just above and adjoining town, containing about 57 acres and bounded as follows.

Beginning at a large beech stump on the bank of Salt River, the S.E. corner of said town of Shepherdsville, thence with East Street N 7° E [for 6 1/2°] 20 poles to a stake being two poles S 7° W from the seminary lot and corner agreed by the parties, thence with the division line through the seminary lot agreed on between the trustees and said Maraman on the S. E. side of the drain through the seminary lot, this division line continued the course as agreed as aforesaid to the agreed corner of Maraman and the seminary lot opposite Third Steet of said town, thence N 83° West to East Street to corner agreed on by Maraman and Seminary [see orders on records of Seminary books for said agreement and corners] thence with East Street and courses of same N 7° E [for 6 1/2°] __ poles to a stake in the original line of Shepherd and McGee, thence with said line S 37° E 167 poles to where the fence between Colemesniel and H. O. Maraman strikes Salt River which is supposed to be the original corner of two beeches and a sugartree on the bank of Salt River, thence down said River meandering the same S 65° W 70 1/2 poles, N 84° W 21 poles, N 42° W 46 4/10 poles to the beginning.

Out of this boundary said H. O. Maraman retains title to one half acre of ground at his ferry landing on Salt River, for the use of said ferry landing, and said Maraman retains his right to the use of the public ferry road leading to his said ferry aforesaid, and said Maraman for the consideration aforesaid conveys the half acre lot in Shepherdsville No. 80 in the new plan of said town, or his title thereto, but without warranty of title for this lot No. 80 except against himself and those claiming by, from or through or under him. With the appurtenances to said lands belonging [with the exceptions aforesaid] to him the said Henry Barth and to his heirs and assigns forever. And the said Maraman covenants and agrees to and with the said Barth to warrant and forever defend the said land and appurtenances here sold, with the exceptions aforesaid unto him the said Henry Barth and to his heirs and assigns forever against the claims of all persons whatever. It is clearly understand out of this conveyance and warranty is reserved the half acre at the ferry landing aforesaid the right of the ferry road as now established or the right to sue any other ferry way for a road to a ferry that the county court may establish to said ferry and the title only by quit claim aforesaid is made to said Lot No. 80. And by consent of the parties a lien is here allowed by Barth and retained by Maraman on the land for the purchase money aforesaid. Witness the hand and seal of said Grantors the date above. State of Kentucky, Bullitt County Sct. I Noah C. Summers, clerk of the county court of said county, certify that this deed from H. O. Maraman and wife to Henry Barth was produced to me in my office on the 12th day of November 1847, and acknowledged by said H. O. Maraman to be his act and deed. Whereupon I have this 7th day of December 1847 truly recorded the same and this certificate in my said office. Att. N. C. Summers, Clerk
