Thomas Smith Heirs to Henry Crist - 365 Acres

On 12 Jun 1789, James F. Moore surveyed a tract of 365 acres for Charles Williams in what is now north-central Bullitt County, and located east of Brook's Spring. Then on 22 Jun 1789, Williams signed the tract over to Michael Garnheart who obtained a deed for it on 20 Apr 1792. Then in 1796, Garnheart sold the tract to Thomas Smith.

Following Thomas Smith's death, his heirs were required by the Bullitt Circuit Court to sell this tract at auction, and it was purchased by Henry Crist on 13 Oct 1808, as shown here. Then Crist sold it to John Beckwith on 7 Apr 1804.

According to James Shanks' 1811 plat drawing, by that time that drawing was made that tract was numbered as #13 and owned by John Beckwith.

This indenture made the 13th day of October in the year of our Lord 1808 between James A. Sturgus, who was James A. Sturgus Jr., and Guy Phelps, commissioners for this purpose appointed by a decree of the Bullitt Circuit Court made on the second day of April 1808 for and on the behalf of Polly Beckwith who was Polly Smith, William Smith, Robert Smith and Thomas Smith, infant heirs of Thomas Smith deceased of the County of Bullitt and Commonwealth of Kentucky of the one part and Henry Crist of the same county and commonwealth of the other part.

Witnesseth that the said commissioners in pursuance of the decrees of the said court made at their February Term 1805, and at their Mary Term 1806 in a cause therein depending between the said Henry Crist, complainant, and the said heirs and others, defendants, have bargained and sold the following tract or parcel of land at public auction on the premises on the first day of August in the year 1806 for the sum of $1,040 the best and highest price that could be had, having advertised the said time and place of sale in the Western American printed at Louisville for one month previous thereto, and that in pursuance of the decree of said made on the second day of April 1808 the said Sturgus and Phelps in the capacity of commissioners as aforesaid for and in consideration of the process and of the application of the said $1,040 by the said Crist to the discharge of so much of the said decree do bargain and sell, alien, release, convey and confirm unto the said Henry Crist, his heirs and assigns forever the said tract or parcel of land containing 365 acres lying and being on Cedar Creek in the County of Bullitt and bounded as follows.

Beginning at two white oaks standing near the Buffaloe Road about four miles northwardly from the Blue Lick, corner to Hardin, and with his line [South] 55° East 253 poles to his corner a beech and elm, thence South 35° West 400 poles to three beeches in a line of Edward William's preemption, thence with a line of the same, [North] 434 poles to a red oak and water beech, thence North 35° East 45 poles to the beginning, with its appurtenances and hereditaments.

To have and to hold the said tract or parcel of land with its appurtenances and hereditaments unto the said Henry Crist, his heirs and assigns, to his and their only proper use and behoof forever. And the said James A. Sturgus and Guy Phelps in ghe capacity of commissioners aforesaid for the heirs aforesaid do further covenant and agree to and with the said Henry Crist, his heirs, administrators and assigns, that so far as real or personal assets descending from the said Thomas Smith deceased to the said heirs may enable them they will forever warrant and defend the said tract or parcel of land unto the said Henry Crist, his heirs and assigns against the claim or claims of them the said heirs and of all persons whatsoever. So that in case of the eviction of the said Crist, his heirs or assigns, therefrom by any lawful claim, the damages sustained thereby are to be paid out of the asests aforesaid, if any there be, in such proportion as the said Crist, his heirs or assigns, may be entitled thereto.
