Sheriff Sale of Multiple Oxley Addition Lots

Benjamin F. Oxley of Missouri purchased land adjoining Shepherdsville from Lorenzo Hoglan, and also land from Wilhite Carpenter. These two tracts were combined into what became known as Oxley's Addition to Shepherdsville. Oxley then began selling town lots in this addition to others. As Oxley was living in Missouri at the time of these sales, the transaction was handled by his brother-in-law, James H. Oliver.

By 1876, many of the purchasers of lots had abandoned them, refusing to pay taxes due. In 1877, the sheriff sold these lots at auction and J. F. Smith and Wilhite Carpenter purchased all of them at the cost of paying the taxes and fees that were due. It appears that none of the previous owners made any attempt to redeem their lots, and in 1896, Smith and Carpenter demanded that a deed be made to them which was done by the sheriff, as shown below.

This indenture made this 19th day of June 1896 between J. B. Monroe as sheriff of Bullitt County, Kentucky of the first part and J. F. Smith and W. Carpenter of the second part.

Whereas the following parties were indebted for tax due the Commonwealth of Kentucky for the year 1876 amounting to $38.20 and listed in the names of C. M. Wheat, Henry Burst, Eben Easel, E. Barrall, James Cochran and Murice Hoffman &c, and said amount not having been paid by the first day of November 1876, the sheriff of Bullitt County could not find personal property to sell to make said amount, he therefore after having demanded payment of the amount of the tax, as stated in the tax receipt, levied upon the real estate hereinafter described as the property of said parties, and said sheriff having duly advertised the time, place and terms of the sale thereof by written notice set up at the courthouse door and three other public places in the vicinity of the land for 15 days next preceding the sale, and having notified the delinquent of the levy made, as required by law, he did on Monday, the 19th day of March 1877, it being the first day of the March term of the County Court, expose for sale at public auction to the highest bidder at the courthouse door of said county for cash in hand the property hereinafter described, when and where J. F. Smith and W. Carpenter being the highest bidder became the purchaser thereof at the price of $38.20, which sum of money has been fully paid to satisfy the amount due for tax, Sheriff's commission, costs etc., and no one offering to take a less quantity of the property offered for sale and pay said tax and costs, and neither the parties the former owners of said real estate, nor their legal representatives having redeemed said property by paying the purchase money, with the legal interest thereon, and costs etc. within __ years from the day of sale as required by law.

Now, in consideration of the facts stated, the payment of said purchase money by said party of the second part, and by virtue of the power and authority vested in the sheriff in such cases, and the party of the second part having demanded of the party of the first part, a deed, therefore J. B. Monroe, as sheriff of said county in the state aforesaid does hereby convey and transfer to the said J. F. Smith and W. Carpenter, their heirs and assigns forever, the following described property, to wit.

The following described town lots in the B. F. Oxley addition of the town of Shepherdsville, Bullitt County, Kentucky, described and numbered as follows: 3/8 of lot #58; lot #23; 1/3 of lots #3, #36 & #37,; 1/3 of lots #40 & #41; #104 & #105; #14 & #15; two lots numbered __; two lots numbered 125 & 126; one lot No. __; 4 lots numbered 18, 19, 28, 29; lots Nos. 115, 116, 117, 118; lots #7, #141 & # 142; one lot numbered __, one lot #13.

According to the list of Oxley Addition purchasers found in the T. C. Carroll plats, the following lots were owned by Smith and Carpenter at the time the list was made: Promie 7; Schrieber 13; Hoffman 14, 15; Borrell 18, 19, 28, 29; Wheat 36, 37; End 50; Weber 58; Figley 62, 63, 64, 65; Helmus 104, 105; Cerf 115, 116, 117, 118; Earl 125, 126; Promie 141, 142; and Cochran 144.

Together with all the appurtenances thereunto belonging, and he will, as sheriff aforesaid, so far as he ought or is legally bound to do, forever warrant and defend the title to the property hereby conveyed unto the said party of the second part, their heirs and assigns forever, for and on the part of the said parties, the former owners thereof, but no further.
