Shepherdsville Trustees to Thomas Shain - Lot 49

It appears that James Shanks was the original purchaser of this Shepherdsville lot, but that following his death and a court suit it was sold by the trustees to Thomas Shain, as shown below. Shain mortgaged it to his business partner Robert F. Samuels in 1841. Then, following Shain's death and according to his will, it was to go to Samuels.

This indenture made this 14th day of May 1832 between Matthew Wilson, John Holsclaw and Robert F. Samuels, a majority of the trustees of the town of Shepherdsville in Bullitt County, state of Kentucky, of the one part and Thomas Shain of said County and state of the other part.

Witness that the said Wilson, Holsclaw and Samuels, trustee as aforesaid, for and in consideration of the power vested in them by law and the premises, have granted, bargained, aliened, released, conveyed, and confirmed, and by these presents do grant, bargain, alien, release, convey and confirm unto the said Thomas Shain, his heirs, executors, administrators and assigns a certain lot or parcel of land containing half an acre, being in and a part of the town of Shepherdsville and known and designated on the map or plan thereof by the number 49, being the same lot, which was sold by William Caldwell, deputy sheriff for James Alexander, Sheriff of Bullitt County, as the property of the heirs of James Shanks dec'd by virtue of an execution in the name of James Cox against said heirs and conveyed by Seth Caldwell, deputy sheriff as aforesaid to said Thomas Shain, who was the purchaser.

To have to hold the said lot or parcel of land and appurtenances unto him the said Thomas Shain, his heirs, executors, administrators and assigns, and to his and their only proper use, benefit and behoof forever, hereby warranting and defending to the said Thomas Shain his heirs, executors, administrators, and assigns the said lot and appurtenances as far as by law they as trustees aforesaid are bound to warrant and defend, and no farther. In testimony whereof the said Wilson, Holsclaw and Samuels, trustees as aforesaid, hereto set their hands and seals on the day and year before written.
