Thomas Shain - 1842 Last Will and Testament

After devising each of his living siblings, and the children of his deceased siblings, one dollar each and no more, Thomas Shain willed his estate to Robert F. Samuels on 19 Aug 1842. His will was recorded on 20 Sep 1842.

In the name of God Amen. I Thomas Shain of Shepherdsville, Bullitt County, Kentucky, being weak in body, but of good mind and disposing memory, do make and constitute this as my last will and testament.

First, I recommend my soul to God, the father of all existing life.

2nd, I wish my remains to be buried in decent burial.

3rd. I wish my just debts to be paid.

4th. I will to each of my brothers and sisters as are living one dollar each and no more of my estate; and to the children of those that are dead, one dollar each and no more of my estate.

5th. I will and devise to Robert F. Samuels, the balance of my estate, if any, both real and personal, land, Negroes and other property, either in this state or elsewhere, to him his heirs and assigns forever.

6th. And lastly, I do hereby appoint Robert F. Samuels the executor of this my last will and testament, hereby revoking all others. In testimony whereof I have hereto set my hand and seal this 19th day of August 1842.

The forgoing last will and testament of Thomas Shain deceased was this 19th day of September 1842 produced an open court by the executor therein named for record, and fully proved by the oath of Preston N. Hornbeck, Noah C. Summers and N. P. Morgan, the three subscribing witnesses thereto to be the true last will and testament of said Thomas Shain deceased agreeably to law and as such duly proved was ordered by said court to be recorded. Whereupon said will together with this certificate are truly recorded in my said office. Given under my hand this 20th September 1842. Attest: Noah C. Summers, Clerk, Bullitt County Court.
