Samuels & Levy Co. to Creditors - Mortgage on Part of Lot 25

On 27 Sep 1854, R. H. Field sold his part of Shepherdsville lot #25 to the firm of Samuels & Levy. The firm was required to mortgage it to a group of creditors in 1855 as shown below.

This indenture made and entered into this 19th of March 1855 between Samuels, Levy & Company of Bullitt County, Kentucky of the first part and George W. Bowman, John Mooney, Henry Trunnell, H. C. Crist, Lewis Wicks & Company, Henry McGloughin, James Crigler and William Shane of the second part.

Witnesseth that the parties of the first part have sold and hereby convey to the parties of the second part the following property:

one house and lot in the town of Shepherdsville conveyed to the parties of the first part by R. H. Field, known in plat of said town as No. __, and also the store house and lot in said town now occupied by the parties of the first part known in plan of said town as part of Lot No. __;

also eight head of horses, to-wit, two bay horses, two grey horses, two bay mares, one sorrel mare, one black mare; also ten head mules, also 16 head of cattle, one wagon, one covered buggy, on buggy not covered;

also the following notes to-wit:

  • one on John Porter and wife for $83.60 due January 3rd 1855,
  • one on Pernelia Bowman for a balance of about $158.00 due January 16th 1855,
  • one note on James Baxter and William Shane for $12.55 due November 21st 1854,
  • one note on H. O. Maraman for $24 due July 11th 1854,
  • one note on Felix Cundiff, Martin Hoglan and James Shepherd for $75 due November 22, 1855,
  • one note on Robert Simmons balance due thereon of about $35 due January 4th 1855,
  • one note on R. J. Hoglan for $50 due January 7th 1854,
  • one note on John Anderson for $68.55 due December 28th 1854,
  • one note on David Henderson for $12.92 due January 20th 1855,
  • one note on Joseph B. Tilford for $26.50 due February 1st 1855,
  • one note on James Shepherd for $14.25 due January 1st 1855,
  • one note on George W. Miels for $27.65 due December 18th 1854,
  • one note on James Y. Pope for $24.15 due January 22nd 1855,
  • one note on John H. Taylor for $33.70 due 1st May 1855,
  • one note on W. W. Gatten for $28.20 due February 10th 1855,
  • one note on H. C. Crist for $49.45 due February 25th 1855,
  • one note on R. J. Hoglan, James F. Smith and Henry Trunnell dated August 29th 1854 on which there is a balance of about $50,
  • one note on Edwin Carpenter and John Welch for $22.50 due 26th March 1855.

Now this conveyance is made on this condition that whereas

  • the said George W. Bowman is the security of the party of the first part to Coleman Bridwell for the sum of $300 and interest,
  • and also said Bowman is the security of the party of the first part to Thomas J. Joyce for the sum of $400 and interest,
  • and also the party of the first part owes said Bowman $200 money got of John B. Cundiff for them,
  • and John Mooney is the security of the party of the first part to William A. Rouse for $500 and interest,
  • and to Woodford McDowell for $175 and interest,
  • and the party of the first part owe said Mooney $260 by notes,
  • and the said Henry Trunnell is the security of the party of the first part to William A. Rouse for $200 and interest,
  • and the said H. C. Crist is security to Henry Congrove for the party of the first part for the sum of $63.00 and interest,
  • and the party of the first owe William Shane $125 and said Shane is their security to __ Purcell, executor of William Collings for $35,
  • and the party of the first part owe Lewis Wicks and Company $90
  • and James Crigler $60,
  • and Henry McGloughlin is the security of the party of the first part to George W. Bowman, executor of G. Joseph Bowman for the sum of $60.

Now this conveyance is made to secure and indemnify the parties of the second part in the payment of their several sums of money aforesaid and should said Samuels, Levy and Company pay the said several sums of money and interest, and all cost attending recovery of the same then this conveyance to be void, otherwise to remain in full force and virtue. The first named house and lot above is under attachment in name of Gowdy & Company for upwards of $200 and costs in Bullitt Circuit Court. Given under our hands, the date above.
