Richard P. Simmons to Thomas Joyce - Shepherdsville Lots 21 & 22

In 1837, Thomas Joyce mortgaged Shepherdsville lots 21 and 22 to Richard P. Simmons, and also placed a second mortgage on his tavern house lot (part of lots 39 and 40). After Joyce paid Simmons what he owed on lots 21 & 22, Simmons released them back to Joyce on 31 May 1839, as shown below.

This indenture made and entered into this 31st day of May in the year of our Lord 1839 between Richard P. Simmons and Mary his wife of the county of Bullitt and Commonwealth of Kentucky of the one part and Thomas Joyce of the other part.

Witnesseth that whereas heretofore to-wit on the 22nd day of March in the year 1837 the said Thomas Joyce by his deed in writing under seal of that date, duly recorded in the clerk's office of the Bullitt County Court in Deed Book H, pages 408-409, conveyed and mortgaged to the said Richard P. Simmons, lots of ground numbers 21 & 22 in the town of Shepherdsville according to the new plan of said town; and the same on which the steam mill of said Joyce now stands to secure to said Richard P. Simmons in the payment of the sum of $1440 for which a note of even date with the deed of mortgage.

Now the said note having been liquidated and surrendered up by the said Simmons to the said Joyce, the said Simmons and wife do hereby in consideration thereof resell and reconvey and release to the said Joyce all of any claim which they acquired in and to said lots numbers 21 & 22 by virtue of the said deed of mortgage, not intending hereby to become in any cause under obligation for the title thereof, but only relinquishing to said Joyce the right and title they acquired of him, under said deed of mortgage.

In testimony whereof the said Simmons and wife have hereunto set their hands and affixed their seals this day and date above written.
