Pope, Pope & Breckinridge to Benjamin Summers - 3 tracts

Robert Breckinridge, Worden Pope, and William Pope Jr. obtained this land from the heirs of John Larue. In many cases title to the tracts of land were in dispute, and these men were selling just their titles under their arrangement with the Larue heirs.

We have located three such sales made to Benjamin Summers as shown below. The first was for 500 acres that appeared to overlay part of the 1500 acre tract patented to John Edwards that lay to the north and east of the 400 acre tract surveyed for Thomas Hardin and patented to John Fristo. The second of 85 acres appeared to overlay the northwest part of the Hardin tract. The third of 365 acres lay to the southwest of the Hardin tract and is shown on the James Shanks plat along with the Hardin tract. It was also claimed by Charles Williams who signed it over to Michael Garnheart.

This indenture made this fourth day of March 1812 between William Pope Jr. and Cynthia his wife, Worden Pope and Elizabeth his wife, and Robert Breckinridge of the county of Jefferson of the one part and Benjamin Summers of Bullitt County of the other part. Witnesseth that the said William and Cynthia, Worden and Elizabeth, and the said Robert for and in consideration of the sum of $100 to them in hand paid by the said Benjamin before the sealing and delivery of these presents have bargained and sold, and by these presents doth grant, bargain and sell, alien, release, convey and confirm unto the said Benjamin Summers, his heirs and assigns, forever a certain tract or parcel of land situate in the said county of Bullitt on Cedar Creek, being the tract on which he lives, containing 500 acres, the same more or less, part of John Larue's survey of 21,000, being the same land he purchased of Peachy Wells and bounded as followeth, to wit.

Beginning at a sugar tree and small forked beech, corner to Hardin's tract of 400 acres, thence North 55° West 253 poles to two poplars, corner to said Hardin, thence North 35° East 260 poles to two white oaks standing between two sink holes, thence South 55° East 362 poles to a stake, thence South 60° West 280 poles to the beginning.

To have and to hold the said tract or parcel of land with all the appurtenances unto the said Benjamin Summers, his heirs and assigns, forever. And the said William Pope Jr., Worden Pope and Robert Breckinridge for themselves, their heirs, executors and administrators doth covenant and agree to the said Benjamin Summers, his heirs &c that the said tract or parcel of landwith all the appurtenances they will warrant and forever defend against themselves and their heirs, and all persons claiming or to claim the same by, through or under them, and against the claim of all persons to claim the same under the title of John Larue, deceased, but not against the claim of any other person or persons whatsoever; it being the intention of the parties that the title of John Larue, deceased, is the only one hereby sold and that of all persons claiming under said title. In testimony whereof the said Popes and Breckinridge have set their hands and seals this day and year first mentioned. Bullitt County Sct. I Frederic W. S. Grayson, clerk of the county court in and for the county aforesaid, do hereby certify that on the 6th day of March 1812 the within indenture was acknowledged by William Pope Jr. as well for himself as the attorney in fact of Robert Breckinridge and by Worden Pope to be their voluntary act and deed and that I have recorded the said indenture together with this certificate in my office as required by law this 7th day of December 1812. This indenture made this second day of June between William Pope Jr. and Cynthia his wife, Worden Pope and Elizabeth his wife, and Robert Breckinridge of Jefferson county of the one part and Benjamin Summers of Bullitt County of the other part. Witnesseth that the said William and Cynthia, Worden and Elizabeth, and the said Robert for and in consideration of the sum of $85 to them in hand paid, the receipt of which is hereby acknowledged, have granted, bargained and sold, and by these presents doth grant, bargain and sell, alien, release, convey and confirm unto the said Benjamin Summers, his heirs and assigns, forever a certain tract or parcel of land situate in the said county of Bullitt, part of John Larue's survey of 21,000, and bounded as followeth, viz.

Beginning at two poplar trees, corner to Thomas Hardin's survey of 400 acres, running thence South 35° West 126 1/2 poles to an ash tree, thence South 55° East 108 poles to a black walnut, thence North 35° East 126 1/2 poles to a hickory and two poplar trees, thence North 55° West 108 poles to the beginning, containing by survey 85 acres and eight poles, being the same more or less.

To have and to hold the said tract or parcel of land with all the appurtenances unto the said Benjamin Summers, his heirs and assigns, forever. And the said Worden Pope, William Pope Jr. and Robert Breckinridge doth covenant and agree to and with the said Benjamin Summers, his heirs &c that they will warrant and forever defend the said tract of land unto the said Benjamin Summers, his heirs, &c against themselves and their heirs and all persons claiming under them, and against the claim of every person claiming the same under the title of John Larue, but not against the claim of any other person. Nevertheless should the said land or any part thereof be lost or taken away by any adverse claim, they will pay him, his heirs or assigns one dollar per acre for each and every acre that may be thus taken or lost.

Bullitt County Sct. I Frederic W. S. Grayson, clerk of the county court in and for the county aforesaid, do hereby certify that on the 4th day of June 1812 the within indenture was acknowledged by William Pope Jr. as well for himself as the attorney in fact of Robert Breckinridge and by Worden Pope to be their voluntary act and deed and that I have recorded the said indenture together with this certificate in my office as required by law this 7th day of December 1812. This indenture made this 29th day of September, in the year 1813 between William Pope Jr., Worden Pope, and Robert Breckinridge of Jefferson County of the one part, and Benjamin Summers of Bullitt County of the one part. Witnesseth that the said, William Pope Jr., Worden Pope, and Robert Breckenridge for and in consideration of the sum of $449 to them in hand paid before the sealing, and delivering of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, and sold, and by these presents do grant, bargain and sell unto the said Benjamin Summers, his heirs and assigns, a certain tract or parcel of land situate in the said county of Bullitt on which John Beckwith resides, part of John Larue's survey of 21,000 acres, and containing by estimation 365 acres, be the same more or less, and bounded as follows, viz.

Beginning at two white oaks standing near the old buffalo road, being a corner to Thomas Hardin's 400 acre survey, running thence with his Hardin's line South 55° East 253 poles to his corner, a beech and elm, thence South 35° West 400 poles to three beeches in a line of Edward William's preemption, and with a line of the same North 434 poles to a red oak and water beech, thence North 35° East 49 poles to the beginning.

To have and to hold the said tract or parcel of land with the appurtenances unto the said Benjamin Summers, his heirs and assigns, forever; and the said William, Worden and Robert for themselves and their heirs doth covenant and agree with the said Benjamin and his heirs &c that they will warrant and forever defend the said land with the appurtenances unto the said Benjamin and his heirs &c against themselves and their heirs and all persons claiming or to claim the same by, through or under them or any of them, and against all persons claiming or to claim the same under the title of John Larue, deceased, but not against adverse conflicting claims. In testimony whereof we have hereunto set our hands and seals the day and year first written. (signed) William Pope Jr., Worden Pope, Robert Breckinridge by his attorney William Pope Jr.

State of Kentucky, Bullitt County Sct. I Frederic W. S. Grayson, clerk of the county court in and for the county aforesaid, do hereby certify that on the 29th day of September in the year 1813 this indenture was acknowledged by William Pope Jr. for himself as the attorney in fact of Robert Breckinridge and by Worden Pope to be their voluntary act and deed.
