Following the death of Archibald Magruder, two of his daughters, with their husbands, brought suit in county court to have his land divided amongst his children. The court appointed three commissioners to go on the land and make a fair division for the six heirs. Their report to the court was recorded in the county will book. The part allotted to C. R. Samuels and wife included 84 acres.
In November 1871, Mary E. Samuels, widow of C. R. Samuels, sold this 84 acres, and an additional 100 acres deeded to her by the heirs of her two deceased brothers, to Charles M. Schaffer and A. P. LeGros.
Bullitt County Deed Book T, Pages 96-97
This indenture made and entered into this the 17th day of November 1871 between Mary E. Samuels of the one part and Charles M. Schaffer and A. P. LeGros of the other part, all of Bullitt County, Kentucky.
Witnesseth that for and in consideration of the sum of $600, $400 of which is paid in hand, the receipt of which is hereby acknowledged, and the balance, $200 is secured to be paid to the said Mary E. Samuels by note bearing date herewith, payable in two years from date hereof, note to draw interest from date and lien retained on the land to secure the payment of same, the said Mary E. Samuels, party hereto have this day bargained and sold unto the said Schaffer and LeGros, parties hereto, all that land, part of the Archibald Magruder old farm, situated and being in the county of Bullitt and state of Kentucky deeded or allotted to me the said Samuels in the division of said old farm between the heirs of Archibald Magruder dec'd.
My part is designated as lot No. 2 in said division. Said deed of division or allotment is here referred to and made part of this deed and the same can be found of record in Will Book F, page 360, Bullitt County Court.
I the said Samuels by said deed is allotted 84 acres and it is said land that I hereby convey.
And as a further part consideration of rthe said $600 herein mentioned, I the said Samuels also sells and conveys to the said Schaffer and LeGros hereby all that part of the land allotted and deeded to me by the deed of division out of the lands of my, the said Samuels' two brothers Ezekiel and Henry O. Magruder, my the said Samuels' interest in said lands being 100 acres as can be seen by reference to the deed of division of said lands recorded in Deed Book Q, page 386 [338], Bullitt County Court. And a lien is also retained on this piece of land to secure the payment of the said $200 note.
To have and to hold the said 84 & 100 acres of land aforesaid to the said Schaffer and LeGros and their heirs and assigns forever, hereby warranting the title to same to the said Schaffer & LeGros forever against all claims whatsoever.
The said 100 acres of land was allotted to the said Ezekiel and Henry O. Magruder dec'd out of their father's lands. Given under my hand this day and year above written. (signed) Mary E. Samuels
