Benjamin Summers to Rufus K. Summers - 1/3 of Shepherdsville Lot 60

On 5 Aug 1818, James Scott sold Lot #1 (#60 under new plan) to Benjamin Summers. Summers and wife sold one-third of the lot to Rufus K. Summers on 11 Feb 1831, as shown below. Then it appears that he gave Rufus a bond for the remaining two-thirds sometime before Rufus sold the entire lot to Preston N. Hornbeck on 13 Mar 1838.

This indenture made and entered into this 11th day of February in the year of our Lord 1831 between Benjamin Summers and Verlinder his wife of the County of Bullitt and State of Kentucky of the first part, and Rufus K. Summers of the town of Shepherdsville, same county and state of the other part.

Witnesseth that the said Benjamin Summers and wife for and in consideration of the sum of $400 current money to them in hand paid and secured to be paid, the receipt whereof they do hereby acknowledge, have granted and sold and by these presents do grant, bargain and sell unto the said Rufus K. Summers one lot or part of a lot of ground number 60 in the new plan of the town of Shepherdsville, Bullitt County, Kentucky commencing at the southwest corner of said lot on Water Street and extending back along the line of lot No. 59 to the alley 198'11" more or less and with the alley along the back line of said lot No. 60 33'1 2/5" or one-third the length of said back line and from a point one-third the said distance on said back line in a line parallel with the first line to Water Street at 33'1 2/5" from the southwest corner and from thence to the beginning, being one-third of said lot No. 60.

To have and to hold the said one-third part of said lot No. 60 to him said Rufus K. Summers and to his heirs and assigns forever; and said Benjamin Summers and wife covenant to and with said Rufus K. Summers to warrant and defend the said third of said lot to his said Rufus K. Summers and his heirs forever against the claim of themselves and all other persons, and also covenant with said Rufus that they have good right and title in said lot to sell and convey the same. In testimony whereof the said Benjamin Summers and Verlinder his wife have hereunto set their hands and seals the day and date above written.
