John W. Beckwith's Heirs to Cornelius Comyges - 3 Tracts

Following the deaths of James W. Beckwith and Frederic W. S. Grayson, Beckwith's heirs had been ordered to pay Comyges what was owed him, and the heirs of Grayson what Beckwith owed him, or face the sale of Beckwith's three tracts which had been mortgaged to Comyges. With their failure to do so, the Bullitt Circuit Court issued a decree and action were taken in which half of the two mill tracts were sold to pay Grayson's heirs, and then the other half were sold to pay Comyges. James Guthrie, as attorney for Comyges, and James Breckinridge, executor of Frederic Grayson, each purchased an undivided half of the two mill tracts. As that was not sufficient to cover what was due to Comyges, the 250 acre was also sold to compensate him further. Comyges would later sell his share of the 2 mill tracts along with the 250 acre tract to John H. BakerTow days later Breckinridge sold his share of the 2 mill tracts to Baker.

The 50 acre mill tract, located mostly in the river bed, also included Shepherdsville lots 65-76.

This indenture made this 25th day of October 1828 between George F. Pope, commissioner (appointed by a decree of the Bullitt circuit court in the case of Cornelius Comyges and Company against John W. Beckwith's heirs &c) for and on behalf of Minerva E. Beckwith, Basil Beckwith, Mary Ann Beckwith, and Frederic G. Beckwith, heirs and representatives of John W. Beckwith dec'd of the one part and Cornelius Comyges of the other part.

Witnesseth that the said George F. Pope, commissioner as aforesaid, for and in consideration of said decree hath, and by these presents doth grant, alien, release, convey and confirm unto the said Cornelius Comyges, his heirs &c one undivided moiety or half of a certain tract or parcel of land situate, lying and being on the north side of Salt River in County of Bullitt containing 150 acres and bounded as follows, to-wit.

Beginning at two black walnuts and three mulberry saplings on the north bank of Salt River, thence North 79° East 240 poles to a black or red oak, elm and sweet gum saplings in a flat, thence South 6 1/2° West 49 poles to a stake corner to the graveyard, thence with a line of the same North 83° West 25 poles to another stake, thence South 6 1/2° West six poles to another stake, thence South 83 1/2° East 25 poles to a stake, thence South 6 1/2° West 26 poles to a line of Peter Shepherd's 600 acre survey on the bank of Salt River, thence down the river and binding thereon with its meanders to the beginning.

Also the undivided moiety or half part another tract or parcel of land containing 50 acres, containing principally in the bed of the river aforesaid and bounded as follows, to-wit.

Beginning in the upper line of the aforesaid 150 acre tract at the injunction of the lower line of Water Street, thence with said street line up the river as far as Walnut Street, thence with said street to the river, thence up the river to a large beech marked A.S., corner to Peter Shepherd's 600 acre survey, thence with a line thereof South 36° West to the south side of Salt River and so far up the bank thereof as shall be 7 feet perpendicular height above low water mark, thence down the river at the distance aforesaid to a point opposite the beginning course of the aforesaid tract of 150 acres, thence crossing the river to the beginning corner of the said 150 acre tract, thence up the river with the lines of the said 150 acre tract to the beginning.

Also the undivided moiety or half of another tract or parcel of land containing 250 acres lying back of and below the town of Shepherdsville and bounded as follows, to-wit.

Beginning at a stone corner to the 150 acre tract aforesaid, thence North 79° West 160 poles, thence North 4° West 369 poles, thence South 35° East 317 poles, thence South 6 1/2° West 100 poles, thence North 79° West 40 poles, thence South 6 1/2° West 40 poles in the first line, thence South 79° East 40 poles to the beginning.

To have and to hold all the right, title, interest, and claim of the said Minerva E. Beckwith, Basil Beckwith, Mary Ann Beckwith, and Frederic G. Beckwith, heirs and representatives of John W. Beckwith dec'd of in and to the undivided moiety or half parts of the the aforesaid three tract or parcels of land with the appurtenances thereto belonging unto him the said Cornelius Comyges, his heirs &c, and to his only proper use, benefit and behoof forever from them the said Minerva E. Beckwith, Basil Beckwith, Mary Ann Beckwith, and Frederic G. Beckwith, heirs and representatives as aforesaid, and from the claim or claims of all and every person or persons lawfully claiming or to claim the same by from through or under them, but not against the claim or claims of any other persons.

In testimony whereof the said George F. Pope, commissioner as aforesaid, hath hereto set his hand and seal and the hands and seals of the said Minerva E. Beckwith, Basil Beckwith, Mary Ann Beckwith, and Frederic G. Beckwith on the day and year first before written.
