John H. Baker to Matthew Wilson, 13 Oct 1845

Following a court decree, a town lot and house, and a ten acre tract belonging to John H. Baker were sold at auction to Matthew Wilson.

Whereas in the suit in chancery depending in the Bullitt Circuit Court in the name of Matthew Wilson against John H. Baker, the said court did by its decrees of the 8th of April 1845 decree in favor of the complainant certain sums against defendant to be paid or or before the 3rd day of the next term of said court or on failure certain property in the bill deed filed as exhibit in the cause from Matthew Wilson and wife to said Baker shows being a house and lot on Water Street in Shepherdsville and a ten acre lot near said town and 2 four acre lots near said town should be sold by H. C. Thomas, a commissioner appointed for that purpose, to pay said sums decreed complainant, viz. $819.75 and interest from 9 July 1840 and $16.32 and costs of said suit subject to a credit of $149.07 paid 16th of March 1841, and said defendant Baker failing to pay said sums so decreed against him, the said court by consent of the parties by its order in said cause of the 18 April 1845 and the agreement of the parties direct said property to be sold. The plaintiff Wilson agreeing to look to the sale of the said property only for the said debts so decreed. And said commissioner H. C. Thomas in pursuance to the said decrees and orders in said cause advertised said lots and lands for sale agreeably to the said decree to be sold at the courthouse door in Shepherdsville on the 19 of May 1845; and on said 19 May 1845 said commissioner did sell said lots and lands agreeably to the directions of said decree and order and Matthew Wilson the complainant became the purchaser of the lot and houses and appurtenances on Water Street in Shepherdsville for the sum of $500. And said Wilson purchased the 10 acre lot for the sum of $40 and Frederick Travis purchased the two four acre lots for $85. Said commissioner's report was on the 8 Oct 1845 filed in said court by said commissioner in said cause and affirmed, and deeds were directed to be made to said purchasers by order of said court; and Noah C. Summers was appointed a commissioner to made said conveyances for and on behalf of said Baker and Travis.

Now therefore this indenture made this 13th day of October 1845 between said John H. Baker by N. C. Summers, commissioner for him for that purpose, of one part and said Matthew Wilson of the other part, witnesseth that the said Baker by said Summers, commissioner for him for that purpose, in consideration of the said decrees and orders and sales and purchases as aforesaid, has sold and conveyed and by these presents does sell, convey, confirm and release unto him the said Matthew Wilson and to his heirs and assigns forever the said house and lot of ground on Water Street in the new plan of the town of Shepherdsville, being part of lot #58 in the plan thereof, and bounded as follows.

Beginning on the alley on Water Street at the southeast corner of said lot, thence back with the alley S 6½° E 110 feet, thence N 83½° W (at right angles) 30 feet, thence S 6½° W 110 feet or parallel to the alley to Water Street, thence S 83½° E (with Water Street) to the beginning with its appurtenances being the same lot conveyed by said Wilson and wife to said Baker by deed dated 14 September 1837, recorded in Bullitt County Court office.

And said Baker by said N. C. Summers, commissioner as aforesaid, sells, conveys and confirms unto the said Wilson and to his heirs forever said ten acre lot of land near Shepherdsville bounded as follows.

Beginning at the northwestwardly corner of the tract now owned by Quirey and Tyler, near and adjoining said town and with their line N 79° W 110 poles to a stake, thence with a line of a tract once owned by Simmons, N 6½° E 40 poles to a stake, thence S 79° E 40 poles to a stake, thence S 6½° W 40 poles to the beginning; being the same 10 acres conveyed by Adam Shepherd's heirs to William Jones and the same conveyed by the deed herin before recited from said Wilson and wife to said Baker with the appurtenances in Bullitt County, Kentucky. To have and to hold the lots of land and appurtenances aforesaid unto him said Matthew Wilson and to his heirs forever; and said Baker by said Summers, commissioner for him for that purpose, does hereby covenant and agree to and with said Matthew Wilson to warrant and defend the title to said lots of ground and appurtenances herein described unto him the said Matthew Wilson and to his heirs forever against the claims of all persons whatever.
