Matthew Wilson to Elisha Simmons - Shepherdsville Lots 39-40 - Part 5

In 1833, via a Circuit Court decree, William Jones as commissioner deeded to Matthew Wilson, assignee of Joseph Bowman, a part of two Shepherdsville lots (#39 & #40) from the estate of James Brown deceased. This was following a court suit brought by Elizabeth Griffin against the Brown estate.

On 17 Feb 1834, Wilson sold the ground to Elisha Simmons as shown below. Then on 26 Feb 1840, Simmons sold it to Abraham Field.

This indenture made this 17th day of February in the year of our Lord 1834 between Matthew Wilson and Martha T. his wife of the City of Louisville, County of Jefferson, and State of Kentucky of the one part, and Elisha W. Simmons of the town of Shepherdsville, County of Bullitt, and State aforesaid of the other part.

Witnesseth that the said Matthew Wilson and wife for and in consideration of the sum of $150 current money of the United States in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold, and by these presents do grant, bargain and sell, alien, release, convey and confirm unto the said Elisha W. Simmons, his heirs and assigns a certain lot of ground in the town of Shepherdsville and being numbered five in the commissioner's plat, sold by said commissioners for the benefit of the Bullitt Academy and being a part of lots No. 39 and 40, in the new plan of said town, and bounded as follows, to wit.

Beginning on Main Street of said town at the southeast corner of said lot No. 40, thence with the line of the alley North 83 1/2° West 198 feet, 11 inches to the southwest corner of lot No. 39 on School Alley, thence with a line of said alley North 6 1/2° East 39 feet, 8 3/4 inches to a stake, thence South 83 1/2° East 198 feet, 11 inches to a stake on Main Street, thence with a line of said street 39 feet, 8 3/4 inches to the beginning.

The same being that part of said lot which is vacant lying between G. W. Jenkins and A. Field with its appurtenances unto the said Elisha W. Simmons, his heirs &c forever. And the said Matthew Wilson and Martha T. his wife for themselves, their heirs, executors, administrators and assigns covenant and agree to and with the said Elisha W. Simmons that they will forever warrant and defend the said lot of ground and appurtenances unto the said Elisha W. Simmons, his heirs &c forever against the claim or claims of all and every person or persons claiming or to claim the same. In testimony whereof the said Matthew Wilson and Martha T. his wife hereto set their hands and seals the day and date before written. [signed by grantors]
