Frederick Fundy, whose surname was spelled variously as Fondy, Fondey, and Fonda, purchased a tan yard tract from Milton Bodine on 12 Oct 1839, and later purchased this neighboring tract from William W. Swearingen on 19 Jun 1848. He would later purchase another adjoining tract from Coleman Bridwell on 20 Mar 1858.

This indenture made and entered into this 19 day of June 1848 between William W. Swearingen of the County of Bullitt and State of Kentucky of the first part, and Frederick Fundy of the county and state aforesaid of the second part.
Witnesseth that the said party of the first part, for and in consideration of the sum of $327 to him paid and secured to be paid by the said party of the second part, the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these presents does grant, bargain and sell, release and confirm unto him the said party of the second part a certain tract or parcel of land lying in Bullitt County, Kentucky, on the waters of Cedar Creek, south side of Salt River, containing 54 1/2 acres (sold at $6 per acre) bounded as follows.
Beginning at an elm and dead white oak corner to A. Sheckles and J. W. Buky, thence with said Sheckles N 1° E (for North) 163 poles, 4 links to a stake, being 11 links S 15° W from a marked white oak, thence S 63° W 122 poles to a stake in said Bukey's line, being 1 pole S 58° W from a marked gum, thence with said Bukey's line S 44°20' E (for 47 2/4°) 150 1/2 poles to the beginning.
Being the same land conveyed by James Crenshaw and wife to said party of the first part by deed dated February 8th 1848, and recorded in Deed Book L, page 243, in which a certain right of way is spoken of which the said Swearingen also guarantees to said Fundy as far as his said deed expressed it.
To have and to hold the above described tract of land, be the same more or less, with its appurtenances unto him the said party of the second part, his heirs and assigns forever. And the said party of the first part doth hereby bind himself, his heirs &c forever to defend the aforesaid tract of land and appurtenances unto him the said party of the second part, his heirs and assigns against the claim or claims of all and every person whatsoever. In witness whereof the said party of the first part hath hereunto set his hand and seal the day and date first above written. (signed) W. W. Swearingen.
