Coleman Bridwell to Frederick Fundy - 64 Acres

Frederick Fundy, whose surname was spelled variously as Fondy, Fondey, and Fonda, purchased a tan yard tract from Milton Bodine on 12 Oct 1839, and later purchased a neighboring tract from William W. Swearingen on 19 Jun 1848. He later purchased this adjoining tract from Coleman Bridwell on 20 Mar 1858.

This indenture made and entered into this 20th day of March 1858 between Coleman Bridwell of the county of Bullitt and state of Kentucky of the first part, and Fredrick Fonda of the county and state aforesaid party of the second.

Witnesseth that the said party of the first part, for and in consideration of the sum of $646 in hand paid, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, and by these presents doth grant, bargain, sell and convey unto the said party of the second part, his heirs and assigns a certain tract or parcel of land, situate, lying and being in the county of Bullitt, south side of Salt River, on the head waters of east fork of Cedar Creek adjoining the lands on which said Fonda now lives, and bounded as follows.

Beginning at a stake in a line of a tract of land sold by H. Crist to Rodolphus Buky, it being S 58° W 1 pole from a marked gum, and corner to land sold by William W. Swearingen to said Fonda, thence with said Buky's line N 44 1/4° W (for 45°) 20 1/4 poles to a stone, Buky's corner, thence with another of Buky's lines S 50° W 5 poles to a black oak and maple stump in said line, thence N 26° W 23 3/4 poles (for 23 poles) to a white oak (the dogwood not found), thence N 35° E 80 poles to a stake, original a poplar (gone), thence N 32° E 27 poles to a stake and large black oak (the former corner of white oak and walnut are gone), thence N 69 1/2° E (for 68°) 34 poles to a stake (where formerly a poplar stood) and corner to 9 1/2 acres formerly owned by Bodine, thence with Bodine's line S 35° E 22 poles to a stake, formerly a sugar tree, Bodine's corner, thence S 83° E 32 1/3 poles (for 28 poles) to a honey locust, redbud and ironwood (the redbud gone) and corner to land sold by H. Crist to Rhoda Crenshaw and children, thence with said line S 1° W (for South) 56 poles to a stake in Sheckles' line, being S 15° W 11 links from a marked white oak and corner to land sold by William W. Swearingen to said Fonda, thence with said line S 63° W 122 poles to the beginning, containing 64 acres, be the same more or less.

The above named boundary conveyed being part of a 117 3/4 acre tract formerly conveyed by H. Crist to Rhoda Crenshaw and her heirs, together with all and singular the appurtenances thereunto belonging or in any wise appertaining.

To have and to hold the land hereby conveyed unto the said party of the second part, his heirs and assigns forever, and the said party of the first part will and his heirs shall forever warrant and defend the title of the land herein conveyed against the claim or claims of all and every person or persons whatever, together with Elizabeth Bridwell his wife who relinquishes her right of dower in and to the lands conveyed in this deed, hath hereunto set their hands and seals the day and date above written.
