Rowan J. Stoner to Casper Herps - September 1859

In September 1859, Rowan J. Stoner sold undivided half shares of a number of tracts lying in the southern part of Bullitt County mainly along the waters of Wilson Creek to Casper Herps. It appears that Stoner's claim to these tracts may have been not completely secure, for he warranted them only against himself and his heirs, but not against anyone else. Herps later sold his share of the lands to Adam and Ben Chapeze.

Bullitt County Deed Book O, Pages 546-7

This indenture made, and entered into this 1st day of September 1859 between Rowan J. Stoner of the county of Bullitt and state of Kentucky of the first part and Casper Herps of the county and state aforesaid of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of $200 in hand paid, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, and by these presents, doth grant, bargain, sell and convey unto the said party of the second part, his heirs and assigns the undivided moriety or one half in three certain tracts of land lying on the Waters of Wilson Creek, and one moiety of another 200 acre tract lying on Hart's Run adjoining Ben Doom's 1000 acres, and two hundred acres patented to Darwin B. Stoner; also one moiety of a fourth acre tract patented to said R. J. Stoner lying on a west branch of Hart's Run and between the above named two hundred acre surveys. The above named tree tracts were patented to Rowan J. Stoner. And for and in consideration of a further sum of $300 in hand paid, the receipt whereof is hereby acknowledged, it also being for the undivided moiety or one half of a 200 acre tract lying on the waters of Wilson's Creek patented to Darwin B. Stoner.

To have and to hold the undivided moieties in the above named four tracts of land unto the said party of the second part, his heirs and assigns forever; and the said party of the first part doth hereby agree that he will forever warrant and defend the title from himself and his heirs, but not against any other claim or claims whatsoever. In witness whereof the said R. J. Stoner together with isabelle Stoner his wife, who hereby relinquishes her right of dower in and to the four moieties of the four tracts of land conveyed in this deed, hath hereunto set their hands and seals the day and date above written.
