Sometime prior to the death of Adam Chapeze, Casper Herps had sold his share of multiple tracts that he had obtained from R. J. Stoner to Adam and Benjamin Chapeze. However, no deed had ever been made to the land. Then in May 1884 a deed was signed from Herps to the Chapeze heirs, as shown below.

Whereas some years ago C. Herps bargained and sold to A. & B. Chapeze certain lands lying in Bullitt County on the waters of Wilson Creek for the consideration of $960, and said sum having been paid by said A. & B. Chapeze before the death of said A. Chapeze, and no deed having been made or executed heretofore, now therefore this indenture made and entered into this the 30th day May 1884 between C. Herps of the county of Bullitt and state of Kentucky, party of the first part, and Marion Chapeze, Susan Hagan, wife of James O. Hagan, Lucy Chapeze, Lizzie Chapeze, Flaget Chapeze and B. H. Chapeze, children and heirs of said Adam Chapeze and Ben Chapeze Sr., parties of the second part, that for and in consideration of the sum of $960 in hand paid said Ben Chapeze Sr. and A. Chapeze before his death, the receipt whereof is hereby acknowledged, hath granted, bargained, sold and hereby convey by deed of General Warranty the four undivided moieties in four tracts of land lying on the waters of Wilson's Creek (first) one moiety in a 200 acre patent to R. J. Stoner lying on Hart's run, one moiety of a 200 patent to D. B. Stoner, and one moiety in a 40 acre patent to R. J. Stoner which contains by actual survey 54 acres, also one moiety in a tract of land adjoining said 40 acre patent and the lands of Lewis Duvall which is bounded as follows.
Beginning at a beech, patent corner to Ben Doom's 1000 acres, also patent corner to John M. Duvall's 53 acres, thence with Duvall's line S 33° E 31 3/4 poles to a hackberry, beech and hickory, the beech now standing corner to 160 acres sold by Shain to Davis, and corner to 240 acres sold by Shain to Lewallen which deeds are recorded in Book A, page 393 and 395; thence with Lewallen's marked line N 48 1/4° for 39° E 152 poles to three dogwoods and sugar tree, corner to said Lewallen tract, also corner to 100 acres deeded by Shain to Dragoo, recorded Book A. page 393; thence with said Dragoo's line N 39 1/2° E following an anciently marked line 68 poles to two fallen chestnut oaks, now two black oaks marked for corners on the spur of a knob, corner to said Dragoo tract; said 100 acres was owned by Lewis Duvall, the two last named tracts call for no person's lines on the Bullitt side, thence from the two fallen chestnut oaks, N 44° W 52 poles to a stake, thence N 40 1/2° E 74 poles to a beech and hickory at the forks of a drain, thence S 75 1/3° W 23 1/2 poles to a chestnut oak and hickory, corner to Henry Younger and with his line N 18° W 50 poles to forked beech, corner to Stivers' 40 acre patent and with the same S 86° W 136 poles to a hickory, white oak and beech in Doom's line of 1000 acres, and with the same S 1° W for South 264 poles to the beginning, containing 200 acres more or less.
It is known by the parties that R. J. Stoner patented 4 tracts of land containing 640 acres, all lying adjoining, and said Stoner conveyed one half to C. Herps, and the moiety deeded by Stoner to Herps is herein deeded to Chapeze. Stoner sold his moiety to Chapeze. Also if the said 640 acres is hereafter surveyed and contains less than 640 acres, Stoner and Herps are to make up the loss in equal portions to said Chapeze, and if the land gains, Chapeze is to pay Stoner and Herps at the rate of $3 per acre in equal portion.
To have and to hold the four undivided moieties in the aforesaid tracts of land unto the parties of the second part, their heirs and assigns forever.
In testimony whereof the said C. Herps together with Susan M. Herps his wife, who hereby relinquishes all her right of dower and interest in and to the lands conveyed in this deed, have hereunto set their hands and seal the day and year first written.
