Nicholas Simmons to John H. Baker, 1837

In March 1837, John H. Baker purchased 123 acres of land from Nicholas Simmons that lay north of the forge tract and adjacent John Chaddic's land. This was originally a part of a tract patented to the heirs of Lynaugh Helm. The land was likely purchased for the timber on it. It appears that Chaddic had a partial claim to this tract, as he was also compensated in this deed.

This indenture made 11th day of March and the year of our Lord 1837 between Nicholas Simmons and Elizabeth his wife of Bullitt County and state of Kentucky of the one part and John H. Baker of the same place of the other part. Witnesseth that Nicholas Simmons for and in consideration of the sum of $247 to him in hand paid, the receipt of which is hereby acknowledged, they said Simmons and wife have sold and by these presents do sell, convey and confirm unto the said John H. Baker and to his heirs forever the following tract of land in Bullitt county on the north side of Salt River containing 123 acres and a half more or less, and bounded as follows, viz. Beginning at two hickories in Shepherd's line, corner to the land purchased by said Baker of John Chaddic Jr., thence with the line of said Baker's land North 10° West 242 poles to a black oak in the back line, a corner of said Baker's land, thence with the back line South 89° East to three black oaks in the back line, a corner to John Chaddic Sr's land, thence with a line of said John Chaddic Jr. South 47° East 187 poles to three hickories and white oak, Chaddic's corner in Shepherd's line on Mud Run, thence with Shepherd's line North 53° West to the beginning with its appurtenances, being a part of the same land conveyed to said Simmons by Benjamin Chapeze by deed dated 3rd of January 1828, recorded in the County court office of Bullitt in book F, page 416 and conveyed to said Chapeze by Benjamin Helm and Philip Reed by deed dated 28th of March 1819, record in same office in book D, page 235, conveyed to said Helm &c by the register of the land office and recorded in the office of the general court - the land was patented to the heirs of Lineigh Helm by patent dated 17th of March 1800. To have and to hold said land here sold with its appurtenances unto the said John H. Baker and heirs forever. And the said Nicholas Simmons for himself and his heirs does hereby covenant and agree to and with the said John H. Baker that he said Nicholas Simmons will and his heirs shall warrant and forever defend the said title to the land here sold unto him the said John H. Baker, and to his heirs forever against the claim or claims of all and every person or persons whatsoever. Witness the hands and seals of the grantors. (signed) N. Simmons, Elizabeth Simmons.

John Chaddic becomes a party to this deed and he receives the sum of $61.50 in consideration of and on account of his claim to the foregoing land and he hereby covenats to and with said John H. Baker and his heirs that if the land here sold is taken away from said Baker or lost by any other or better claim than the one named in this deed that he will pay to said John H. Baker the said sum of $61.50 and interest on same. This is a consideration paid to Chaddic in addition to the sum paid said Simmons. Witness my hand and seal this 7th April 1837.
