Heirs of Robert F. Samuels to John D. Bryan - Parts of 4 Town Lots & More

Following the deaths of Robert F. Samuels and his son Charles R. Samuels, the heirs were required by a circuit court suit to sell parts of four Shepherdsville Lots (13, 14, 15, 29) and also a nearby 18 plus acres at auction to John D. Bryan.

This indenture and conveyance made and entered into this 27th day of October 1869 between Malinda Samuels, widow of Robert F. Samuels dec'd, Hugh M. Samuels, Robin Jacob Samuels, Fanny Samuels & Kate Samuels who are the children of Kate Samuels dec'd and William Thomas Samuels, and William T. Samuels, the father of said children, Mary Samuels, widow of C. R. Samuels dec'd and her children, namely Kate Samuels, Phil Lee Samuels & Josie Samuels by Casper Herps, commissioner, parties of the first part, and John D. Bryan of the county of Bullitt and state of Kentucky, party of the second part.

Whereas in a suit heretofore pending in the Bullitt Circuit Court in which Robert F. Samuels' executor and curator were plaintiffs, and Robert F. Samuels' heirs and creditors were defendants, the said R. F. Samuels, by his last will and testament appointed his son Charles R. Samuels his executor, and on the 12th day of February 1863 at court and in open court resigned his executorship, and said court appointed Wesley Phelps curator of said decedent's estate, and afterwards said curator filed a petition asking a decree to sell the real estate of said decedent for the purposes of satisfying and to pay certain debts; and whereas the court by its order dated 23rd day of April 1868 appointed Wilhite Carpenter a commissioner for the purpose of selling said real estate named in the petition, and said commissioner, after advertising said sale as directed in the decree at the court house door in the town of Shepherdsville did on the 21st day of September 1868 expose for sale at the court house door in said town, it being County Court day, the following property, viz: one moiety in four town lots, designated in said town plan as lots Nos. 13, 14, 15 & 29; and John D. Bryan became the purchaser, he being the highest and best bidder for the sum of $26, and at the same time and place said commissioner offered for sale 18 1/4 acres lying in Bullitt County, adjoining the town of Shepherdsville, and is part of the land heretofore deeded by Nall & Benthall to Robert F. Samuels, and John D. Bryan became the purchaser, he being the highest and best bidder for the sum of $150, and said commissioner having had said land surveyed is therefore bounded as follows:

Beginning at a stake northeast corner to 23 acres originally deeded by Adam Shepherd to Halbert, thence with Halbert's line North 82° for 83° West about 59 poles to a stake in a line of Beckwith's 250 acres, now A. H. Field's line, thence with said line North 8° for 6 1/2° East, the variation of the line of Main Street of said town about 79 poles to a stake corner to 9 3/4 acres deeded by Pope to Fields, thence with Field's line South 36° East about 91 1/2 poles to a stone opposite and in the east line of Main Street when extended, thence with said line when extended South 8° for 6 1/2° West __ poles to a stake opposite the beginning corner, thence North 82° West __ poles to the beginning, containing 18 1/4 acres.

And whereas at the court held and at the October term 1869, the court by its order appointed Casper Herps a commissioner for and on behalf of the parties of the first part to convey to the party of the second part the aforesaid four undivided moieties in said lots Nos. 13, 14, 15 & 29; also said 18 1/4 acres. Now therefore for and in consideration of the premises, decree, sale and the above stated amounts of $26 and $150 in hand paid to said Wesley Phelps as curator and receiver as shown and endorsed on the purchase bonds, the parties of the first part named in this deed, by C. Herps, commissioner, have this day granted bargained, sold and hereby convey by deed of general warranty to the party of the second part, his heirs and assigns, said undivided moieties in said four lots, also said 18 1/4 acres, the boundary of which has been heretofore described.

To have and to hold the aforesaid described premises unto the party of the second part, his heirs and assigns forever against the claims of the parties of the first part, and against the claim or claims of all other persons as fully as by law said commissioner can warrant. In testimony whereof I Casper Herps as commissioner hereby witness the signatures of the parties of the first part this 27th day of October 1869.
