Otho B. James to John R. James - One-Third of 54+ Acres

On 1 Mar 1857, Rufus K. Summers sold a tract of about 54 acres to the brothers Otho B. James, William H. James and John R. James. On 4 Mar 1870 Otho sold his one-third share to his brother John as shown below.

This indenture made and entered into this fourth day of March 1870 by and between Otho B. James and Lucretia his wife of the first part and John R. James of the second part, all of Bullitt County, Kentucky.

Witnesseth that the first parties for and in consideration of the sum of $209.36 settled and paid, the receipt hereby acknowledged, have granted, bargained and sold, and by these presents do convey and confirm unto the second party all his undivided, right, title, interest, and claim of in and to a certain tract of land, lying and being on or near Floyd's Fork, a tributary of Salt River; the whole tract containing 54 acres two roods and 20 poles, and the first parties' interest therein being 1/3 undivided interest. The whole tract bounded as follows.

Beginning at a stake near a red oak corner to John Grant, thence with his line South 26°20' East 131 2/15 poles to a white oak and ironwood in James' line, thence with their line North 60° East 85 poles to a stone marked "R.J.", thence North 30° West 82 3/4 poles to a stake in Martha E. Balee's line, thence with her line North 87 3/4° west 91 poles to the beginning, containing 54 acres two roods and 20 poles, more or less.

The land herein is valued at $11.50 per acre. And the first party here in agrees to warrant and defend his said 1/3 interest in the land here in conveyed against all claims by general warranty.
