Joseph Nichols' Heirs to Samuel Nichols - 244 Acres

On 4 Dec 1838, the heirs of Joseph Nichols sold this land to Samuel Nichols. This land ran from the mouth of Cedar Point Branch upstream toward Pitts Point, and was part of the 2000 acres patented to Samuel Beall.

Whereas on the 31 March 1838, Norborne B. Beall by his deed of that date conveyed to Malinda Davidson, wife of Albert Davidson, late Nichols, Rebecca Goldsmith, late Rebecca Nichols, Shadrack Nichols and Delia Nichols for the consideration of $50 paid by said Shadrack Nichols, 244 acres of land in Bullitt County, see deed of record in Bullitt County Court office book I, page 105, will more fully appear, and he the said Shadrack Nichols having paid Beall the full consideration for said land, the others claim no interest in said land, he said Shadrack Nichols has sold said land to Samuel Nichols of Bullitt County, Kentucky for the sum of $275 and is to make title to the same and procure the relinquishment of the other parties to said Samuel.

This indenture therefore made this 4 day of December 1838 between said Shadrack Nichols of Bullitt County and Delia Nichols of same place, and said Albert Davidson and Malinda his wife, Rebecca Goldsmith of the County of Philips and State of Arkansas of the first part, and Samuel Nichols of the County of Bullitt and State of Kentucky of the other part. Witnesseth that hte said Shadrack Nichols and others of the first part for and in consideration of the said sum of $275 to said Shadrack Nichols, in hand paid, the receipt whereof is hereby acknowledged, they said Shadrack &c, parties of the first part, have sold, and by these presents sell and convey unto the said Samuel Nichols and to his heirs forever the said tract of 244 acres of land in Bullitt County, state of Kentucky, and bounded as follows, viz.

Beginning at the mouth of Cedar Point on the upper side at a hackberry and hickory, thence South 65° East 70 poles to an ash and small beech, thence South 18° East 41 poles to a sugar tree and small beech, thence South 35° East 470 poles to a small oak and dogwood, thence South 81° West 74 poles to a sugar tree and beech, thence North 36° West 90 poles to a sugar tree, thence South 81° West 30 poles to a beech, thence North 58° West 42 poles to a beech, thence North 45° West 32 poles to a small beech, thence North 62° West 18 poles to an elm, thence North 49° West 50 poles to a hackberry and hickory on the bank of Salt River, thence down the river to the beginning with the appurtenances.

To have and to hold the said tract or parcel of land and appurtenances unto him the said Samuel Nichols and his heirs forever, and the said Shadrack Nichols covenants and agrees to and with the said Samuel Nichols to warrant and forever defend the title of the said land unto him the said Samuel Nichols and his heirs forever against the claim or claims of all and every person or persons whatsoever do and will warrant and forever defend by these presents. And Mrs. Priscilla Nichols , the mother of the parties, joins in this deed to relinquish her title and dower to said land if any she has. Witness the hands and seals of the grantors.
