John Gaither's 500 Acre Tract

Ben Pope surveyed a 500 acre tract for John Gaither on 7 Jul 1789 on the south side of Salt River near Floyd's Fork. A deed to the tract was issued on 22 Apr 1792. The tract was based on a treasury warrant originally issued to John Fristoe, as shown in the warrant displayed at the bottom of this page. Then on 22 Apr 1780, Fristoe endorsed the warrant over to William Brashears, who then endorsed it over to John Gaither on 24 May 1780.

After a dispute with Jeremiah Tilford over the land boundary was settled in court which may have affected this deed, John Gaither and his wife Mary sold this tract to Michael Troutman on 27 Jul 1804.

Surveyed for John Gaither assignee, 500 acres of land in Nelson County on treasury warrant No. 3130, lying on Salt River and bounded as followeth, viz - Beginning at (A) two hoop ash trees & maple sapling opposite the mouth of Floyds Fork, thence North 40 East up the river & binding thereon 140 poles, thence North 70 East 40 poles, thence East 50 poles, thence South 65 East 90 poles to (B) a white oak & beech standing on the river bank above the mouth of Cedar creek, thence South 18 East 235 poles to (C) a buckeye Spanish oak and ash, thence South 72 West 283 poles to (D) a sugar tree, thence North 18 West 235 poles to (A) the Beginning. Henry Lee Esquire, Governor of the Commonwealth of Virginia, to all to whom these presents shall come greeting. Know ye that by virtue of a land office treasury warrant number three thousand one hundred and thirty issued the twenty sixth day of February one thousand seven hundred and eighty there is granted by the said Commonwealth unto John Gaither a certain tract or parcel of land containing five hundred acres by survey bearing date the seventh day of July one thousand seven hundred and eighty nine lying and being in the county of Nelson on Salt River and bounded as followeth, to wit. Beginning at two hoop ash trees and a maple sapling opposite the mouth of Floyds Fork, thence North forty degrees East up the river and binding thereon one hundred and forty poles, thence North seventy degrees East forty poles, thence East fifty poles, thence South sixty five degrees East ninety poles to a white oak and beech standing on the river bank, above the mouth of Cedar Creek, thence South eighteen degree East two hundred and thirty five poles to a buckeye Spanish oak and ash, thense South seventy two degrees West two hundred and eighty three to a sugar tree, thence North eighteen degrees West two hundred and thirty five poles to the Beginning. With its appurtenances to have and to hold the said tract or parcel of land with its appurtenances to the said John Gaither and his heirs forever. In witness whereof the said Henry Lee Esquire, Governor of the Commonwealth of Virginia hath hereunto set his hand and caused the lesser seal of the said Commonwealth to be affixed at Richmond on the twenty second day of April in the year of our Lord, one thousand seven hundred and ninety two & of the Commonwealth the Sixteenth.
