Martin G. Holmes to David Haldeman Jr. - 5 Mt. Washington Lots

On 10 Oct 1842, Martin G. Holmes was indebted to several men including David Haldeman Sr. who was also his security for the debts to the others. To secure Haldeman in these debts Holmes mortgaged his five Mt. Washington lots plus additional land, slaves, and property to Haldeman Sr. as shown in the first deed below. Then on 29 Mar 1844, Haldeman Sr. assigned the mortgage value to his son David Haldeman Jr. in exchange for Texas land obtained for him, as shown in the second deed below. On that same day, Haldeman Jr. relinquished everything except the town lots back to his father as shown in the third deed below. Then, in the fourth and fifth deeds below, Haldeman Sr. and Holmes relinquished the town lots to Haldeman Jr.

David Haldeman Jr. then sold the five lots to James Wright on 3 Mar 1845.

Whereas I stand justly indebted to David Haldeman in the sum of $935.50 for which sum I have executed to said Haldeman my notes, each bearing interest from this date until paid. I also stand justly indebted to Richard A. Webb in the sum of $392.31 for which sums with interest from this day I have executed to him my notes of this date, with David Haldeman my security for the payment of said sum. I also stand justly indebted to John Harris in the like sum of $392.31 for which I have executed to said Harris my notes of this date with David Haldeman my security for the payment of the same with interest from the date hereof. And I also stand justly indebted to John Pound in the sum of $506.00 for which sum with legal interest from this date I have executed my notes to said Pound with said David Haldeman my security.

Now to secure said Haldeman in his own debt and for his securityship to me for the debt due R. O. Webb, John Harris and John Pound as aforesaid, I have this day put and pledged and do by these presents put and pledge to the said David Haldeman the following lots, viz. lot No. 9, 13, 17, 21 & 25 situated on the south back street in the town of Mt. Washington, Kentucky with the appurtenances thereon. Also 197 2/3 acres of land situate on Coxes' Creek on the south side of Salt River, and on which Mrs. Sarah Thomas now lives, and deeded to her and her children by Henry Crist, which deed is referred to. Also one negro boy slave named Jack, aged 17 years; also one negro girl named Eliza, aged 13 years; and one other negro girl aged 11 years, and one negro boy named Thomas, aged 7 years; four feather beds and furniture, one bureau, one clock, six Windsor chairs, and one settee; the title of said lots, negroes, beds and furniture, bureau, clock, chairs and settee, I will warrant and defend and, it is agreed that the property aforesaid shall warrant in my possession during the continuance of this mortgage, and it is expressly understood that in case I shall well and truly pay to said Haldeman the amount due him as set forth in this mortgage, and also pay the amount of the claim of R. O. Webb, the amount of the claim of John Harris, and the amount of the claim of John Pound as aforesaid for which several sums the said Haldeman has entered himself as security aforesaid, and keep the said Haldeman from the payment of the same, the said Haldeman is to reconvey to me said lots, land, negroes, beds, bureau, clock, chairs and settee hereby mortgaged to him the said Haldeman, otherwise this mortgage to remain in full force and virtue in law. For and in consideration of a tract of land lying and being in the Republic of Texas secured to me by my son David Haldeman, a citizen of the Republic of Texas, I hereby assign to my said son David Haldeman the debt of $930.50 due from M. G. Holmes to myself as specified in the mortgage executed to me by said Holmes the 10th day of October 1842, which debt is further evidenced by the said Holmes' two notes of hand executed to me upon the 10th day of October 1842, to-wit: one note for the sum of $467.25 due and payable the 1 January 1844 with legal interest from the date it was executed. The second note for the sum of $467.25 executed the 10th day of October 1842, due and payable the 1st day of January 1845 with legal interest from this date.

I also hereby transfer and assign to my said son David Haldeman all my right, title and claim both legal and equitable in and to the said mortgages made to me by the said Holmes and all the property therein specified and described and declared to be in mortgage. I hereby relinquish to David Haldeman Sr. all my right, title and interest in and to the property named in the within mortgage except the lots 9, 13, 17, 21 and 25 and appurtenances thereunto belonging, which have been this day conveyed to me by M. G. Holmes and Rosanna A. Holmes his wife. David Haldeman Sr. in satisfaction of the two notes named within given by said Holmes to David Haldeman Sr. the 1st day of October 1842 and transferred to me the 29th of March 1844, my debt being satisfied, I have no further claim to the balance of the property named in the within mortgage. Whereas M. G. Holmes on the 10th day of April 1842 mortgaged to me, David Haldeman Jr. divers articles of property, to-wit, lots 9, 13, 17, 21 and 25 situate on the south side of Back Street in the town of Mt. Washington, Kentucky with the appurtenances; also 197 2/3 acres of land on the south side of Salt River in Bullitt County, Kentucky; also one negro boy slave named Jack, one negro girl named Eliza, one negro girl named Marial, one negro boy named Thomas, four feather beds and furniture, one bureau, one clock, six Windsor chairs, one settee which si more fully described in said mortgage, which is of record in the Bullitt County Court clerk's office, Deed Book K, page 20; the debt named in said mortgage due from said Holmes to me having been transferred to my son David Haldeman together with all my right, title and interest in said mortgage on the 29th day of March 1844, and the said debt having been satisfied by the conveyance of Lots NO. 9, 13, 17, 21 and 25 named in said mortgage to the said David Haldeman Jr. by the said Holmes and wife and David Haldeman Sr., the said David Haldeman Jr. has released to me the said David Haldeman Sr. this day all claim that he had or obtained to the property named in the said mortgage by the said transfer to him the said David Haldeman Jr. I hereby release to said Holmes all right, title and claim that I have in and to the said property except the five lots named in the said mortgage and invest him with the legal title to the same. This indenture made and entered into this second day of April 1844 by and between Martin G. Holmes and Rosamond A. Holmes his wife, and David Haldeman Sr. of Bullitt County, State of Kentucky of the one part and David Haldeman Jr. of the Republic of Texas of the other part.

Witnesseth that the said Holmes and wife and the said David Haldeman Sr. for and in consideration of the sum of $1,031,92 to them in hand paid by the said David Haldeman Jr., being the amount of principal and interest of two notes of hand given by said Holmes to said David Haldeman Sr. and set out in a mortgage from said Holmes to said Haldeman Sr. dated 10th day of October 1842 and recorded in the clerk's office of the Bullitt Circuit Court in Deed Book K, page 20, which mortgage was by said David Haldeman Jr. transferred by assignment on said mortgage paper to said David Hardeman Jr. on the 29th day of March 1844 in Deed Book K, page 194 in Deed Book aforesaid, which is referred to, have by these presents for the consideration aforesaid bargained and sold unto the said David Hardeman Jr. and doth by these presents grant, bargain and sell, alien, release, convey and confirm unto said David Hardeman Jr. five lots in the town of Mt. Washington, Bullitt County, state aforesaid, situate on south Back Street numbered 9, 13, 17, 21 & 25 together with the appurtenances unto the said David Haldeman and his heirs. And the said Holmes and wife covenant with said Haldeman Jr. that the lots hereby conveyed they will and their heirs shall forever warrant and defend the legal title of said lots to him, his heirs, executors, administrators or assigns from the claim of all persons lawfully claiming or to claim the same, and the said David Haldeman Jr. doth hereby surrender all title, claim and interest he has by said mortgage of said lots unto David Haldeman Jr. In testimony whereof the said Holmes and wife and the said David Haldeman Sr. hereto set their hands and affix their seals the day and year first written.
