Myers' Heirs to Alonzo C. Kinnison - 3125 Acres

On 18 Sep 1832, Austin Hall, deputy sheriff for Sheriff James Samuels, carried out an order of the Bullitt Circuit Court in the name of Henry C. M. Cartmell, administrator of Peter Kern dec'd for the benefit of Henry Crist to sell a tract of land originally patented by Luke Wheeler about 3125 acres on Knob Creek which was in the hands of John Myers and other heirs of Jacob Myers.

Alonzo C. Kinnison was the high bidder at $10 and was issued this deed, as shown below.

This indenture made this 18th day of September 1832 between Austin Hall, deputy sheriff for James Samuels, sheriff of Bullitt County of one part, and Alonzo C. Kinnison of the same county of the other part.

Witnesseth that whereas there issued from the clerk's office of the Bullitt Circuit Court an execution Fieri Facies dated the 10th day of August 1832, No. 565, in the name of Henry C. M. Cartmell, administrator of the estate of Peter Kern dec'd for the benefit of Henry Crist for the sum of £226.19 & 4/6 and $11.45 and $11.26 and $13.72 debt and $6.91 cost with a credit of $272.04 1/2 and $7.96 1/2 against the estate of Jacob Myers' heirs and representatives directed to the sheriff of Bullitt County, made returnable the 6th October 1832, which execution came to the hands of said Hall, deputy sheriff as aforesaid, to levy and execute, which said Fieri Facias execution was by said deputy sheriff levied upon the estate of Myers' representatives, consisting of a tract of land of about 3125 acres in Bullitt County, being the same tract patented for Luke Wheeler's 3125 acre tract including the place whereon Joel Vaughn now lives & lying on the waters of Knob Creek in Bullitt County, and which said tract of land was by said deputy sheriff duly advertised for sale agreeably to law and regularly sold at the courthouse door in Shepherdsville on the 17th day of September 1832 to the highest bidder and said Alonzo C. Kinnison being the highest bidder became the purchaser at the price of ten dollars on a credit of three months, all of which will more fully appear by reference to the return of said deputy sheriff on said execution in these words, to wit:

"By virtue of this execution I levied on all the right, title and interest of the within heirs of Jacob Myers in and to the tract of land lyin on Knob Creek containing 3125 acres patented to Luke Wheeler and advertised and sold the same at the courthouse door in Shepherdsville on the 17th day of September 1832, being court day at a credit of three months, and Alonzo C. Kinnison purchased the same at ten dollars, he being the highest bidder. Reduce Sheriff's commission of fifty cents leaves $9.50 to be credited on this execution. A. Hall, D.S. for James Samuels S.B.C."

Now in consideration of the premises and the sale aforesaid I, said Austin Hall, deputy sheriff aforesaid, have and by these presents do sell and convey unto said Alonzo C.Kinnison all the right and interest of the said John Myers and other heirs of Jacob Myers dec'd of in and to the said Kinnison and his heirs and assigns forever. And I do hereby warrant and defend said land and appurtenances to him and his heirs and assigns against the claims of them the said John Myers and other heirs as aforesaid, and against the claims of all others as fully as I can by law do without in any event whatever making myself individually liable.
