Commissioner's Report

The following report was made in response to a Circuit Court case, transcribed just below. Details of the case settlement may be seen in two deeds by which the participants were granted portions of the Bullitt's Lick tract. In the first one, Congrove deeded part to Kinnison and Jones; in the second one, Kinnison and Jones deeded part ot Congrove. Images of the original report are viewable in the T. C. Friday, October 6, 1837

William Congrove, Complainant vs Alonzo C. Kinnison, William Jones &c, Defendants, in chancery

This day came the parties by their attorneys and it is admitted that William Pope will prove he would not have sold his interest in Bullitt's Lick tract of land &c to Kinnison & Jones & Congrove and taken the notes of the parties severally but required their joint notes, and this cause came on for final hearing and was heard in the bills, answers, cross bills and answers, depositions and exhibits filed and the court being advised is of opinion that Congrove is entitled to one-half of the two-fifths and one-half of two-thirds of one-fifth in and to Christian's one thousand acre survey called the Bullitt's Lick tract; as also the like proportions of Christian's two thousand acre survey under the purchase from William Pope, and that Jones and Kinnison are entitled to the same proportion of said surveys under the aforesaid purchase from William Pope.

The Court is also of opinion that Congrove is entitled to one-tenth of each said surveys under his purchase from William Bullitt.

In order to enable the court to make a final decree herein, Abraham Field and Jonathan D. S. Peacock are hereby appointed commissioners who are directed to go on said surveys and divide and lay off said tracts according to the directions herein, and that they lay off Jones & Kinnison's interest so as to include their improvements, estimating the land in its natural state without regard to the improvements put on the land by them, and that they lay off to Congrove his interest so as to include his improvements, estimating the land in its natural state without reference to the improvements put there by him, or the value thereof, paying in each instance due regard to quality in its natural state, supplying the defects of quality by quantity in its natural state as aforesaid, and that they make report herein by fair and intelligible plats at the next term of this Court, and that they meet and bind the residue of the tracts in manner and form as aforesaid.


Report of the commissioners J. D. S. Peacock & John Graham, and is made part of the report in the case of Kinnison, Jones and Congrove. [a, b, c, d, e, f represents the 88 acres represented in the report of J. D. S. Peacock and A. Fields, and for the courses and distances which bound the said 88 acres reference is made to said report.

Boundary of that part of the 1000 acre tract known by the name of the Bullitt's Lick tract which is allotted to William Congrove, the plaintiff in this case, viz.

Beginning at a double willow on bank of Salt River & above the mouth of a small drain & two willows on the lower side of said drain at [Z] on plat, thence N 53° W 30 poles up said drain to a beach tree, & two water beeches on said drain (see former report), thence up the drain N 36 1/2° W 58 poles, N 8 1/2° W 14 poles, N 28 1/2° W 11 poles to two beeches at [G] on plat, (see former report), thence N 35 1/2° W 50 poles to a forked white oak and hickory by the side of a path (see former report), and at [F] on plat, thence N 82 1/2° W 45 poles to a sycamore on the west bank of Bullitt's Lick Run at figure [1] on plat, thence N 77° W 10 poles to two white oaks on a ridge at figure [2] on plat, thence S 85° W 58 1/2 poles to a pine sapling & hickory & white oak at [3] on plat, thence N 10° E 188 poles to a stone at [4] on plat on the bank of the Lick Run, thence up the same N 20° W 29 poles, N 49° E 6 poles, N 68° W 16 poles to three black walnuts from one root and double honey locust, elm and water beach on the bank of Lick Run at [7] on plat, thence N 55° E 10 poles to a red oak, sweet gum, and hickory at [C] on plat (see former report), thence on same course 146 poles, in all 156 poles to a large beech tree in the original line of the 1000 acre tract [B] on plat (see former report), thence with the original S 39° W 324 poles to a dead white oak and sugar tree on the bank of Salt River at [A] on plat (see former report), thence down the river with its meanders to the place of beginning (see former report).

Boundary of that part of the said 1000 acre tract allotted to William Jones & A. C. Kinnison, viz. Beginning at a large beech tree in the original line of the 1000 acre tract at [B] on plat (see former report), thence N 39° E[W?] 141 poles to a walnut stump at [P] on plat (see former report), thence N 55° W 402 poles to a large white oak stump at [S] on plat (see former report), thence S 39° E 428 poles to two hickories, one of which is double, & a white oak at [b] on plat & corner to 88 acre tract (see former report), thence with the line of the same 77 poles to three hickories & a white oak on a ridge at [C] on plat (see former report), thence with the line of the same S 39° E 148 poles to a small crooked elm, hackberry & hickory at [d] on plat (see former report), thence N 51° W 13 poles to two beeches & sugar tree in a gut at [e] on plat (see former report), thence South 40 poles to a stone at [f] on plat (see former report), thence S 39° E 32 poles to a maple & sycamore on the bank of Salt River (see former report) at [g] on plat, thence up the river with its meanders to the mouth of a drain at a double willow & two willows on the lower side of said drain at [Z] on plat and corner to William Congrove's boundary, thence with Congrove's line the courses as follows N 53° W 30 poles up said drain to a beech & two water beeches, thence up the same N 36 1/2° W 58 poles, N 8 1/2° W 14 poles, N 28 1/2° W 11 poles to two beeches at [G] on plat, thence N 35 1/2° W 50 poles to a forked white oak & hickory on the side of a path (at [F]), thence N 82 1/2° W 45 poles to a sycamore on the west side of Lick Run, thence N 77° W 10 poles to two white oaks on a ridge, thence S 85° W 58 1/2 poles to a pine sapling & hickory & white oak, thence N 10° E 188 poles to a stone on the bank of Bullitt's Lick Run, thence up the same N 20° W 29 poles, thence N 49° E 6 poles, N 68° W 16 poles to three black walnuts from one root & a double honey locust, elm, water beech on the bank of Lick Run, thence N 55° E 10 poles to a red oak, gum & hickory, thence on same course 146 poles, in all 156 poles to a beech the place of beginning. We are informed by the partys that they do not wish the 2000 acre survey divided as in original order specified, all of which is respectfully submitted to the Honorable Court by the commissioners last appointed.
