James Burks to R. P. Simmons & Sons - Part of Shepherdsville Lot 56

While most original Shepherdsville lots were sold as whole lots, the one sitting at the corner of Main and Water Streets (originally numbered as #5, and later as #56) was divided in half, with Thomas McGee purchasing the southern half, and John Scott the northern part

On 25 Sep 1798, Scott Sr. deeded part of the half-lot to his son John Scott Jr. It is confusing to read, but apparently Scott Sr. had already sold parts of the half-lot to others including perhaps Zachariah DeWitt and Isaac Pomroy who then sold their shares to James Burks who sold the ground to Richard P. Simmons, Nicholas Simmons and Alfred Simmons as shown below. Later, Simmons sold the ground to Abraham Field, giving him full ownership of the northern half-lot.

This indenture made this 26th day of October 1824 between James Burks and Matilda, his wife of the county of Jefferson and state of Kentucky of the one part, and Richard P. Simmons, Nicolas Simmons and Alfred Simmons, merchants trading under the firm and known by the style of R. P. Simmons and Sons in the town of Shepherdsville, Bullitt County and state aforesaid of the other part.

Witnesseth that the said James Burks, and Matilda, his wife, have this day for and in consideration of the sum of $75 specie, the receipt whereof they do hereby acknowledge, granted, bargained, and sold, and by these presents grant, bargain, sell, alien, release, convey and confirm unto the said Richard P. Simmons, Nicolas Simmons and Alfred Simmons, merchants as aforesaid, two certain lots or parcels of ground on the west side of Main Street in the town of Shepherdsville.

The first of said lots or parcels bounded as follows, viz., 15 feet, 4 inches in front and 99 feet, 5 inches back. The last mentioned lot or parcel of ground is bounded as follows, viz.

Beginning at a stake on Main Street, thence South 6 1/2° West 11 feet, 8 inches to a stake, thence North 83 1/2° West 99 feet, 5 inches with a parallel line with Water Street across lot No. 5 on the old plan of said town (Shepherdsville), thence North 6 1/2° East 11 feet, 8 inches along the line of the original lot, thence South 83 1/2° East 99 feet, 5 inches to the beginning, which above described lots or parcels of ground are parts of Lot No. 5 on the old plan of Shepherdsville, reference being had to two deeds, one from Joseph Saunders, deputy sheriff for Benjamin Summers, late sheriff of Bullitt County to James Burks. The other from Zachariah DeWitt and Elizabeth Dewitt his wife, which deeds are of record in the office of the Bullitt County Court will more fully appear.

To have and to hold the above described lots or parcels of land with all and singular the appurtenances thereunto belonging or in any wise appertaining unto the said Richard P. Simmons, Nicholas Simmons and Alfred Simmons, their heirs &c to their only proper use, benefit and behoof forever. And the said James Burks and Matilda his wife for themselves and their heirs &c do covenant agree to and with the said Richard P. Simmons, Nicholas Simmons and Alfred Simmons and their heirs &c that they will and their heirs shall warrant and forever defend te above described lots or parcels of land to the said Richard P. Simmons, Nicholas Simmons and Alfred Simmons and their heirs &c against the claim of themselves and all persons claiming by, through or under them, and against the claim or claims of all and every person or persons lawfully claiming or to claim the same. In testimony whereof the said James Burks and Matilda his wife have here set their hands and affixed their seals the day and year first written. [signed by James Burks]
