James Brown to Wilford Lee - Shepherdsville Lots 39-40 - Part 2

In 1826, via a Circuit Court decree, John W. Beckwith, Weir Tilford and William Jones as commissioners deeded to Wilford Lee parts of two Shepherdsville lots (#39 & #40) from the estate of James Brown deceased. This was following a court suit brought by Elizabeth Griffin against the Brown estate.

It appears from other deeds that this ground may have been sold first to Nathan Harris, but he may have forfeited it causing it to be sold again to Lee. Lee later sold the ground to Thomas Joyce.

This indenture made this twelfth day of September in the year of Christ 1826 between John W. Beckwith, Weir Tilford and William Jones of the County of Bullitt and State of Kentucky, commissioners appointed as herein after recited of the one part, and Wilford Lee of the County and State aforesaid of the other part.

Witnesseth that whereas heretofore to wit at a Circuit Court continued and held for the Bullitt Circuit at the courthouse in Shepherdsville at the May term in the year 1822 of said court in a suit in chancery therein defending wherein Elizabeth Griffin was complainant and James Brown's heirs were defendants. By the decree of said Court in said cause had the said Beckwith, Tilford and Jones were appointed commissioners to made conveyance of certain lots of ground in the town of Shepherdsville, which said lots were decreed to be sold as the property of the said James Brown deceased.

Now therefore these presents further witness that the said John W. Beckwith, Weir Tilford and William Jones for and in consideration of the premises and the purchase money for the same have this day bargained and sold and by these presents do sell and convey to the said Wilford Lee a certain lot or parcel of land situate lying and being in the town of Shepherdsville and known by as being a part of lots No. 39 and 40 in the new plan of said town as well as by their Nos. 11 and 12 in the old plan of said town, being lot No. 2 sold by the commissioners under said decree, the said lot joins Main Street by a part of 39 feet 8 3/4 inches running back parallel with the river joining Joyce's house on the lower side thereof 198 feet 11 inches with all and singular the appurtenances thereunto belonging, or in any wise appertaining to him the said Wilford Lee and his heirs forever.

And the said John W. Beckwith, Weir Tilford and William Jones do hereby covenant and agree to and with the said Wilford Lee that they will and their heir shall shall forever warrant and defend to him the said Lee all the right, title, claim and interest in and to the said lot and appurtenances hereby conveyed with which they were invested by virtue of said decree as fully as they as commissioners are enable to do. But the ydo not undertake to become personally responsible to the said Lee or his heirs or assigns in case the title with which they are invested and hereby convey should prove invalid. In testimony whereof they have hereunto set their hands and affixed their seals as commissioners the day and date first herein written. (Signed by commissioners.)
