Martin Bodine to Lawrence Roby Sr. - 134.25 Acres

On 12 Oct 1839, Martin Bodine sold 134.25 acres to Lawrence Roby Sr. This was the same land he had purchased from the heirs of Joseph Hedges in two parts; first from four of the heirs, and second from W. B. Hamilton who had obtained ownership from the remaining Hedges' heirs.


Bullitt County Deed Book I, Pages 226-227

This indenture made and entered into this 12th day of October in the year of our Lord 1839 between Martin Bodine of the one part and Lawrence Roby Sr. of the other part, all of Bullitt County, Kentucky.

Witnesseth that the said Bodine for and in consideration of the sum of $802 to him in hand paid by the said Roby, the receipt whereof he doth hereby acknowledge, has given, granted, bargained and sold, and by these presents does give, grant, bargain, sell and convey unto the said Roby a certain tract or parcel of land situate lying and being in the county of Bullitt on the waters of Cedar Creek, south side of Salt River, and bounded as follows, to wit.

Beginning at a dogwood and red oak, thence N 50° E 80 poles to a red oak, thence N 40° W 244 poles to a stake, thence S 50° W 88 poles to a red oak, thence S 40° E 244 poles to the beginning, containing 134 1/4 acres with its appurtenances.

But there is excepted out of this conveyance and not intended to pass hereby 12 1/2 acres of land within the above boundary claimed by and interfered with by Cosby Crenshaw. And there is also excepted out of this conveyance the right of way five feet wide through a part of the above described tract from the tan yard on and adjoining tract to a spring with the privilege of water on the tract hereby conveyed as evidenced by deed of even date herewith from the said Martin Bodine to Frederic Fundy. And the said Martin Bodine does hereby convenant and agree to and with the said Roby that he the said Bodine will and his heirs shall forever warrant and defend the title to the said tract of land hereby conveyed with the exceptions before excepted against the claim of him, the said Martin Bodine and all and every person or persons whatever claiming or to claim the same.

Memo: This is the same tract of land that Martin Bodine formerly lived on, here sold, and purchased of William B. Hamilton &c. The 12 1/2 acres excepted out are here sold and conveyed by quit claim, interfered with by the claim of Cosby Crenshaw, and lies on the end of the land named in this deed next to where Cosby Crenshaw now lives. And for the same consideration named in this deed, said Bodine does convey to said Lawrence Roby and his heirs forever all the claim, right, title and interest he has in and to the said 12 1/2 acres of land covered by the boundary in this deed, and excepted out. But in case the said 12 1/2 acres of land herein conveyed to Roby is ever lost to said Roby, he said Bodine is in no event whatever liable to said Roby or his assignees therefore, being fairly understood that Bodine conveys said 12 1/2 acres by quit claim title without any warranty.
