Richard Bibb to James A. Sturgus - 400 Acres

At some point, not yet determined, the 400 acre survey patented to George May (shown in the plat drawing below), became the property of Richard Bibb. Then, in 1802, he deeded it to James A. Sturgus (since spelled Sturgees) as shown in the transcription and deed image below. Sturgus sold it to John Beckwith in 1807.

This indenture made this twenty fourth 24th day of November in the year of Christ one thousand eight hundred and two between Richard Bibb and Lucy his wife of the county of Bullitt of the one part and James A. Sturgus of the same county of the other part. Witnesseth that the said Richard Bibb and Lucy his wife hath bargained and sold and by these presents for and in consideration of two hundred and forty pounds current money of Kentucky in hand paid, the receipt whereof is hereby acknowledged, doth bargain and sell unto the said James A. Sturgus one certain tract or parcel of land lying in the county of Bullitt on the south side of Salt River by estimation four hundred acres more or less, which said tract of land was granted to George May by patent bearing date the first day of June one thousand seven hundred and eighty two, and bounded as follows. Beginning at a walnut and two small hickories standing on the river bank at low water mark, a corner to James Honey's nine hundred and seventy acre survey, running thence South twenty one degrees East four hundred and ninety poles to a red oak and elm, thence North eighty eight degrees West two hundred and ninety poles to a stake in James Honey's line, thence with Honey's line North thirteen degrees East four hundred and sixty poles to the beginning to have and to hold the aforesaid four hundred acres of land more or less with all and singular the appurtenances thereto belonging or in any wise appertaining to the only proper use and behoof of him the said James A. Sturgus and his heirs forever, and the said Richard Bibb for themselves and their heirs doth covenant and agree to and with the said James A. Sturgus, his heirs and assigns that he the said Richard Bibb and Lucy his wife and their heirs, the said land with all and singular the premises and appurtenances thereto belonging unto the said James A. Sturgus, his heirs and assigns free from the claim of the said Richard Bibb and Lucy his wife or their heirs or grom the claim of all persons claiming under them or either of them, but not from no other person or persons shall will and do warrant and forever defend by these presents and it is further agreed to by the parties to this indenture and clearly understood that if any part or the whole of the aforesaid land shall be recovered from the said James A. Sturgus, his heirs or assigns by a better claim in that case the said Richard Bibb, his heirs , executors or administrators shall refund at two dollars per acre for so much as shall be to recovered in property without interest at cash price. In witness hereof the said Richard Bibb hath hereunto set his hand and affixed his seal the day and year first above written. (The worlds and Lucy his wife interlined in four places before signing.) I James W. Thornberry, a deputy clerk of the Court of the County aforesaid do hereby certify that on the 24th day of November 1802 the foregoing indenture of bargain & sale from Richard Bibb & Lucy his wife to James A. Sturgus was acknowledged before me by the within named Richard & Lucy his wife to be their voluntary act & deed & that the said Lucy Bibb being examined by me privily and apart from her said husband voluntarily relinquished her right of dower to the within described premises, and at the intance(?) and desire of the said James A. Sturgus, I further certify that the same together with this certificate is recorded. (signed) J. W. Thornberry DClk
